Good morning, my fiancee want to file for me she has been in the USA for 6 years now and we have one girl as our baby. I went to the US embassy five years ago with my ex wife. We were both refuse with the visa base on misinterpretation. We have divorce now. Please what do we do now. And if possible what are the required document the embassy of Ghana will need. Thanks

First thing I'd check if you didn't get the lifetime ban for that misinterpretation. If you do then you need to fine out if you're eligible for waiver. 

 

Then you just file k1 visa guide if you're eligible. Might need a lawyer if there's a ban.

I suppose that would depend on what exactly the misrepresentation was in regards to.

More info is needed to adequately give you advice.

What was the misrepresentation 5 years ago that caused your visa denial?  Was it fake documents?  What does your paperwork from that denial say (if you still have it)?  That would be the first step in helping you determine if you have a  ban or not.

 

A lawyer can help you file the waiver, if you are eligible for it.

I'm not sure if you are understanding my question....When you were denied, what was the exact reason you were given?  

You said earlier you were denied for "misrepresentation"----what did you misrepresent, is what I am asking.  

In other words, what about your case was NOT the truth, but you tried to claim it was?

A lawyer can help you file a waiver, if you are eligible for it.  No lawyer can guarantee an approval, of course.

I should retract my last statement in part....

I was not inferring you were fake/your case was fake.

 

I just noticed upon re-reading the original post that you used the word "misinterpretation" which I switched to "misrepresentation" in my mind when reading---hence my deeper questions earlier about any  actual misrepresentation presented to the CO.

 

So when you say "misinterpretation"---can you elaborate more on this?  If it was just a simple visa denial (and not actual misrepresentation), it should have no bearing on your K1 filing years later.

What was the misinterpretation about? You both needed a Visitor Visa I take it? Or is your ex-wife then a US Citizen?

Is your fiancée a US citizen? You say she’s been in the USA for 6 years but that doesn’t mean she’s a citizen. Only citizens can bring fiancées. Green card holders can only bring wives.

I can not believe you do not know what the misunderstanding was, who would forget that?

 

Obviously nobody can answer your question without knowing what the issue is.

 

Sounds like the she is in the US, so presumably has visited the OP recently.
