Hi vjs I have aproblem , i came to US in 2016 on a tourist visa, met my husband in September of 2016 and he asked me a hand in marriage which I accepted and said yes cause i love him , on the 14 of February 2017 we put in my papers to get a Greencard so i can stay with him legally, in August 2017 i got my 2 years greencard which Will expire in 2019 , but things have changed some much the sweet husband turned to be too hash on me , he freaks out for no reason I thought maybe cause of the smoking but even when he’s not high he still rough , he keeps on threatening me that he will divorce me and get me deported for some reason idk , i aksed him if he wants a divorce, he said yes but he insists he wants me deported , i have never done anything bad too him , I don’t do any drugs , have never cheated on him and sometimes he sleeps outside I never complained , am only 22 years have no family in America, he’s the only person i had as family, all i want to know is there anyway i get divorce without getting deported as he says cause ik he will be heard more than me if we go to court cause he’s a citizen, I just want him to let me go freely I can go back to my mum , Am still young and i have dreams of traveling am fine with him having a divorce without i just want to know do i have to be deported when i get a divorce??? I was stilll waiting for the 10 years Greencard but now all i want is go back to ma Maama 😭 any advise I will appreciate

A divorce will not cause you to lose LPR status, nor is it a reason not to be able to complete ROC. You can divorce then file for ROC with a divorce waiver just fine. You just need to show that the marriage was entered into in good faith, and the final divorce decree before it is finalized. He cannot deport you or cause you to lose status.

Thanks for taking your time to read through but I don’t have any one to help with that cause all i have is him , right now am so stressed and couldn’t stay at work just couldn’t hold my tears and my manager had me go home I couldn’t go home was in the parking lot till night that I know he’s going to work

Timeline

Many times angry spouses (or soon to be ex-spouses) threaten to deport the foreigner, or report them to the authorities or something like that---basically try to hold power over the other person by saying things like that.

 

Do not worry, he cannot do anything in regards to you being deported or prevent you from continuing to remove the conditions on your green card so long as you file with a divorce waiver and can prove you entered the marriage in good faith.  This is YOUR immigration process, it is YOUR legal status, it is YOUR green card---not his.

 

If you two do go to divorce court, he does not have any power over you there either "just because he's a US citizen", so don't listen to him in regards to that either...he's just trying to scare you.  You will not be deported because you get divorced.  Even if he calls USCIS and complains or makes accusations against you, they will not do anything unless he can provide concrete proof that you entered the marriage with false intent (ie. just for a green card).  

 

My suggestion to you right now is to begin gathering proof of your bonafide marriage (ie. copies of your utility bills, marriage certificate, copies of your joint bank statements, copies of your identification, copies of your lease, copies of joint health insurance, copies of photos together, etc.) and put them in a safe place without him knowing about it in case he decides to start destroying evidence/keep evidence from you in an attempt to make filing the ROC even harder on you.  If you can store your documentation outside of the home (ie. leave it with a friend for safe-keeping), even better.
