Questions about I 485

Hi,

I apologize if I this question has been asked elsewhere on this forum, but I couldn't find the answers. It looks like many of these forms are renewed periodically so I dare to ask a few things about my I 485.  It would really help if someone who submitted this form recently and was successful could jump in. 

 

1. For Part 1: Question 20:  Last arrival in the US? Do I write the final destination or where I spoke to the CBP officer? (in transit) 

2. Part 5: Question 10: Is your current spouse applying with you? What do they mean? If my spouse is the petitioner/US citizen? In this case yes, because he is filling in the I 130 form for me and the financial guarantee one. 

 

3. And a more general question: I am an F1 student and my husband is USC, so it looks like I qualify for concurrent filling. 

The USCIS has this list of documents prepared https://my.uscis.gov/helpcenter/article/what-must-i-file-with-the-i-485 but it doesn't completely match the Instructions for I 485 list. 

So with I 485 I have to fill in:

1. I-130
2. I-130A

3. I-864
4. I-485
5. I-765 (optional)
6. I-131
 (optional)
7. G-1145 (optional)

PLUS https://my.uscis.gov/helpcenter/article/what-must-i-file-with-the-i-485 ? therefore also Form I-693? Also, how do I obtain this medical examination? Are university health centers able to help me with that? (I will ask tomorrow at my university anyways)

1) Part 1 Question 20: Check your I-94.  Your Last Arrival into the United States is recorded there and answers this question on the form.

 

2) Part 5 Question 10: If your spouse is a USC then no, he is not applying with you.

 

3) The forms you have listed from this guide is correct, however, I do not have knowledge of an F-1 visa to be able to clarify what forms are needed for adjustment.  I can advise that the I-693 medical needs to be completed by a civil surgeon that works on behalf of USCIS.  This link offers more information and a search tool: https://www.uscis.gov/greencard/medical-exam-find-a-doctor

Still in the instructions for the 12/13/2017 version of the I 485 it says:

 

You are NOT required to submit Form I-693 at the time you file your adjustment application, but may do so if you
wish. Because of the time-limited validity of Form I-693, you may choose to submit your Form I-693 after you file
your Form I-485. You may also submit Form I-693 in person at an interview in a USCIS field
office, if an interview is
required. By waiting to submit Form I-693, you may avoid having to repeat the immigration medical examination.
For more information about Form I-693 requirements, visit www.uscis.gov/i-693.

Hello, we didnt send the medical, the lawyer told us that all the AOS process is taking more than a year and we can bring with us to the interview and also I read in some November or December fillers (I dont remember who) that they recived a invitation letter to bring their medical exam to the interview :) you can read those fourums

i-693 is only valid for one year from the date you submit it. With AOS taking longer and longer. Its better to hold off until doing it until you are several months into the process and take it with you to interview. My interview is scheduled 6 days before my i-693 expires so if for any reason there is a delay in my approval - I will have to redo it.
