Simple answer, and a non-issue...thanks for the replies. Do you get it stamped as you come through the Philippines customs?

As you clear immigration all of you stay in the same lane, request the BB stamp, have a great time.   Customs is after immigration, once you have your luggage.

So...the best outcome is for my wife to use her name off of her passport? What about when it comes to our baby?

I don't know how far from San Francisco you live, but the consulate has an outreach schedule that might work for you.

I thought about it, but I wonder how long it takes them to process the passport(and I do know it's not a fast process in the Philippines!)?The closest one to us will be in Seattle in August, don't think that is enough time to get her passport back.

Figure a solid 8 weeks to get the new passport .. just to play it safe.

We have enough time to go ahead and get my wife's passport name change (going in October), so really it was a bad question, lol. 

 

I just thought it shouldn't have been an issue for the OP when they came back to the US, having the marriage license is a good idea to carry.

I know from first hand experience that you DO NOT need the baby's birth certificate at all. You just need your asawa's marriage license, her passport, and the baby's passport.

Yep they said it would take up to 12 weeks for my wife's passport.

That sucks.    It took 6 weeks when my wife renewed her passport through the LA consulate a few years back.     Last year while in the Phils it took under 2 weeks ... now even there things are totally backed up.

No, there is no problem for you or your baby staying for 3 months. You are a Filipino citizen, who has a green card, and is eligible for Balikbayan privilege. Your baby is an American citizen (possibly Filipino citizen) and is eligible for Balikbayan privilege since s/he is your immediate relative. Balikbayan privilege is extended to the Filipino citizen, as well as his/her spouse and minor children. It is valid for stay in the Philippines up to one year.

What state are you from, btw? Different Philippines consulates have jurisdictions over different states.

It should not be a problem having your passport in your maiden name, and having a green card in your married name. Please be sure to bring along a certified copy of your marriage certificate and a copy of your baby's birth certificate. When you will invoke Balikbayan privilege for yourself and your baby at Philippines immigration, you will need both of those documents in addition to your passports.

You can stay in the Philippines for a year without having to go thru immigration/ extension stay since you are still a Filipino Citizen. Not sure about your baby (how old is he/she?). If you have a passport that still shows your maiden name make sure you bring your marriage cert, also bring an affidavit of consent notarized that you husband aggreed/consented your travel with your baby. Also bring your baby's birth cert., they might ask you to present this info on your way back.

Yes, she was born in the US and has a US passport only.

You and your daughter (and hubby) could stay a year without issue if I remember correctly.

Balikbayan one-year visa-free stay

 

Balikbayans – any overseas Filipino returning to the Philippines, including former Filipinos who have acquired foreign citizenship – can stay in the Philippines without a visa for a period of one year. The balikbayan visa-free stay privilege is extended to the balikbayan’s non-Filipino spouse and children, provided they enter the Philippines with the balikbayan.

Former Filipino balikbayans traveling to the Philippines are advised to bring either their old Philippine passport or copy of Philippine birth certificate as proof of their former Philippine citizenship. Accompanying family members of the balikbayan can bring appropriate supporting documents:

  • For the spouse: copy of marriage certificate
  • For each child: copy of birth certificate
  • For adopted children: copy of adoption papers

Philippine Law (R.A. 9174) provides benefits to baikbayans:

  • Tax-exempt maximum purchases in the amount of USD 1,500, or the equivalent in Philippine and other currency, at Philippine Government–operated duty free shops
  • Exemption from Travel Tax, provided that their stay in the Philippines is one year or less. If their stay in the Philippines exceeds one year, Travel tax will apply to them.

Ok, I think my question is answered...but we will bring the babies Birth Certificate just in case...it's not a big deal. Thanks for the info...will work on getting my wife her updated passport.
