Forgot to include passport photos on I130 packet

Hello everyone!

 

I am new to this site. I am from the Philippines. So my husband sent our I130 packet on October 20th and got our NOA 1 October  27th. We applied for CR1 and we are on Texas Service Center. My husband forgot to include our passport photos. He is currently deployed now and my sister in law is the one who will receive any mails from the immigration. He was able to send our packet before his deployment. Now it bothers me because we might get RFE because of that  Im just wondering if we can send our passport photos now since they are still not processing our case to avoid getting RFE  or just wait from them?

Write to USCIS an e mail , and expose your case, because is 99% of a chance that you are going to be striked by RFE 😦 ,tell them and explain that you guys missed the passport photos and would like to them include it in your I130, you don't loose anything asking ...if is negative the answer,well have it ready updated photos and a copy of your NOA 1 and wait for the RFE and send them the photos ASAP.

Quick advise,for the NVC stage,make triple check of your papers with the list they send you.

I'm not a expert on this. But I would imagine the application would likely be rejected. 

 

What you could hope for is the Embassy sends you a letter requested additional information (your photos). Unfortunately this is likely to take quite a long time.

Wait,hold...is not this severe!

USCIS is the one who send the letter, and the application is not rejected, is putted in a hold...

The application isn't rejected, they only want to see what left,and that is: the photos. 

They send you a Request for Initial Evidence, you answer it and they answer you generally 30 to 60 days after you send that.

My advise,write them an e mail,and ask what I put you above,you have nothing to loose!

You do mean that you did not include both your husband's and your passport photos right? Because if you are not currently in the US they do not need your photos till the interview stage. Only your husband's at this point.

In the application they didn't send it! Petitionary's photos!

Ok ,I'm waiting for an answer from NSC about my Case Number, but, really I don´t care now, because, they are so much close of my PD that is going to work when they reach the case and issue the NOA2 or a RFE! Then they finally are going to update , and place it in their Database!
