Hello,

I just found out that my sister over seas is pregnant and due in October! Because I'm so excited I decided to go home to meet the new baby in November or December and stay there for about a month!

However, my K1 based Green card expires on December 30th, 2018 so I'm going to be filing to remove conditions on my residency about early October.

 

My question is will my travel plans be interfered with because of this fact?

Am I gonna be able to leave for that long and reenter on an almost expired Green card? For example entering on December 29th, a day before it expires.

You will have to file ROC about 90 days before the expiration date of your conditional green card, by the way.


Traveling would be just fine. You will receive an one-year extension letter that accompanies your current conditional green card that suffice as proof of legal residency and will be enough to show customs & immigration when you travel.

I do realize that I'll be filling during the 90 days before it expires.

When would I receive the extension is it a week or two after filing? and what happens if I get the Biometrics appointment while I'm out of the country?

The only reason I mentioned the 90 days is because you said you were going to fill early Oct and your GC expires in Dec and I apparently was too tired to correctly calculate lol.


You can reschedule your biometrics but the longer you hold it off, the longer it takes before they start processing your ROC. It usually takes about ~1-2 weeks to receive the extension letter.

Just wondering, how onerous would it be to come back for a day or so to do the biometrics if necessary?  Not sure where in Canada you are traveling to?  If not possible, file the I751 89 days prior to the expiration date, the biometrics appointment will most likely be in late October or early November and then plan to visit your sister in December.  Don't worry about the GC expiring since you will have your extension letter with you anyway.  My wife traveled last year when her GC expired.  When she left, the GC was still valid, but it expired when she was out of the country, and she had no issues.  If the GC is still valid when you come back, that is fine as well.  Valid is valid up until the date it expires.
