Hey there.

Before we apply for k1, We wanted to know what chances do we have.

We already have some red flags, such as age gap(I'm the beneficiary 27 and USC 57) We're gay couple, has been daiting for 3 years, multiple visits there in States,

we've spent Christmas and nye, got pics. I know his friends, we travel within US. He's been married to a woman in his 20s till 30s for 10 years and then he had 3 long term relationships with younger guys.

None of our family know about us, we're not out to them. For me it's not that easy to be gay in Poland. We're very similar in terms of perosnality, we share similar history (like bullying in school)

we're simply a good match, we really love each other(well, otherwise we wouldn't be together)

What do you guys think? I've heard that Warsaw ambassy is rather okay, but our history has some red flags, as you can see.

I would expect you to receive some questions due to the age gap, but your chances are as good as anyone's.  Just prepare yourself for this process.  It is difficult, long, and expensive.....You might want to study the process and procedures, if you haven't done so .

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Well, I've read a lot of threads like this (well, maybe I shouldn't) and I've noticed it's either hit and miss, but there was some succed interviews, though in Asia

I'm not sure how my location helps or not, should USC hire immgration lawyer, should he be present on my interview

so much uncertainty

Being gay is no reason to deny you a visa and I am sure that it will be understood that it can be difficult to come out to family members in some cultures. Poland is as far as I know not a high fraud country so I don't expect you to have much trouble. The age gap can be a red flag but, correct me if I'm wrong, I'm pretty sure a large age gap is pretty common in (male) gay relationships. 

Overal I think you'll be fine as long as you got enough proof that you have a genuine relationship. 

 

You don't need a lawyer. From what I see on the forums they mess up more often than not, they are expensive and truth be told its not that difficult to file. Its just a loooooot of meticulous paperwork. 

The USC is usually not able to attend the interview, but theres a lot of cases, especially with difficult embassies, where having the USC in the waiting room actually helps. But again, I dont think Poland is a high risk country. I don't expect much trouble. Try asking experiences with this embassy in the Europe part of the forums. The embassies are very different from country to country. 

 

Like missileman abovve me said, be prepared for a long and arduous proces. I would advise you to look into the CR1 route in stead of the K1. In hindsight I would have probably gone that route if I'd do it again.

Lawyers cannot improve your chances...  It is likely that a attorney will not be allowed in the embassy for the interview

Indeed, gap is very common in gay relationships, not sure if the Oficer know it though.

 

I thought about the lawyer more as a guide, that would point us everything we should do or don't and explain everything we should know, but thanks for clearing it out.

I've read here thats it's common and possible for the petitioner to be present at the interview in Warsaw, though I'm not sure if he can be present at the window with beneficiary.

So CR1 would be easier to get? I'll need to get married on my visitor visa in the US and then go back, right?

If you read through the guides here on VJ you will know everything the lawyers can tell you. They are very detailed and accurate and I have no doubt you will be able to find your way around. I will even bet that 'we' here at VJ have seen more cases than most lawyers. The collective knowledge and experience here is so vast it blows my mind. 

Go read through the guides and if you have any questions about any of it don't be afraid to ask.

Yes and no. The CR1 takes a little longer to be with your fiance than the K1 (+- 11 months vs +- 9 months). But you don't have to go through AOS when you arrive in the States. You will have a greencard when you hit the ground and are allowed to work and travel without problems (vs having to wait about 3 months to get a work and travel permit for the K1, effectively trapping you to the house). You also don't have the extra fees involved with the AOS and you can plan your wedding properly cause you decide when to get married in stead of within 90 days of entry.

You don't need to marry in the states, but yes you can. There is no rule against getting married in the states on a travel visa or esta. You do need to go back 'home' after you got married. Please note that if you enter the states on a travel visa or esta with the intention to change status you violate the terms of you travel visa/esta and you may face a ban. I would also make sure that you carry documents that prove strong ties to your home country. If they ask you at the border what you are there for and you say you are there to marry your USC fiance they will want to know for sure that you are returning home after the wedding. They will send you back if they have doubts.
