There were some very good and intelligent comments and questions here.  The entire thing is very fishy.  People made good points: where did they meet? she didn't even know her husband's address?  I take it she received a Visa in the American Consulate in Nigeria, but this doesn't mean that the U.S. government will deem their marriage legitimate.   In order to pass an interview for legalization based on claims of marriage, the couple needs to have sufficient proof of cohabitation.  This means bills, lease, bank accounts, etc.  Additionally, when they will go to the interview (and there will be several of those), they will be asked very personal and intimate questions, and these will be very detailed.  If it is found that the petition for legalization is frivolous, not only can he lose his immigration legal status for making untruthful statements of marriage legitimacy, but the Immigration Authorities will not tolerate deception that is so blatant in the first place.  It is obvious that the marriage is a sham, perhaps he hoped to get paid for it?  And once he realized that she is relying on him even for the plane ticket, he lost  interest?  Could that be the case?  Either way, she needs to look for other options.  Perhaps political asylum if she feels that she cannot return back for some political reasons.  It's a difficult and sad case, and that man should be ashamed of himself, but most who do such things are not.  he should've been straight up with her. However, she is the one who is left in the cold.  I do agree with several replies when they question as to how she can come to the U.S. not even knowing her husband's address and after him being so blatantly not interested in her.  I know it's a cliche, but "marriage is a two-way street" and if he is not interested, even her best wishful thinking will not change that.  Best of luck to you and her! She appeared to know but came anyway.  She was foolish to do so as now she needs the money to return to her home.

I agree. In her home country she wouldn't have moved across the street for a man who shows no interest in her, peppers his Facebook page with pictures of other women, cheats on her, doesn't let her know where he is....yet when a green card is brought into the mix people will put up with anything. It's quite sad, really.

Apparently, she knew his address at one time. When she told him that her visa was approved that's when he told her that he had moved and has not told her where he is. She came to US anyway and is staying with a cousin.

 

They met and courted online, not sure how long. On his first visit to Nigeria they were married.

Well, I have been told that women in Nigeria might be more willing to put up with poor treatment, infidelity of husband's because of the social stigma attached to being a divorced woman there. A divorced woman is considered unmarriageable (if that's a word). A divorced woman is not looked on favorably for marriage even if the divorce was the husband's fault, and poor treatment on his part toward his wife. Have I misunderstood how it is in Nigeria in this regard?

I have suspected as much myself because he seems like a total joke. If she can't make her marriage work, she wants to at least be in the US with her daughter.

He refused to help her with the costs of moving here. He made it public on Facebook he was involved with another woman. He couldn't make it more obvious that he didn't want to be with her yet she came. Her visa was granted in order for her to live a regular family life with him, not for her to live with others whilst not even knowing his address. 

 

How did they meet? 

They met online. I'm wondering why he even married her in the first place only to treat her this way. Didn't he know that she would be joining him once visa was approved? She doesn't seem like the type to scam and lie about anything.

Though this mentality definitely still exists in Nigeria, USCIS does not take that into consideration at all.

She must prove that they entered the marriage in good faith to remove conditions. The focus needs to now be on what documentation does she have to prove it ?

In this case as I said before she needs to consult an immigration attorney to guide her through this.

There may be pro bono lawyers for these cases in your area.

AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

May be she came over only for GC and does not want to do anything with the husband.  Now trying to figure out and get advise here as to how she can salvage her GC.

07/27/17 - K1 packet sent at the end of day.

07/31/17 - NOA1

03/22/18 - NOA2

08/28/18 - expected date for medical completion - Sputum test was needed

09/22/18 - anticipated interview date

She has a green card and a right to prove to USCIS that she entered into a good faith marriage. It's up to her adjudicating IO if he sees it as legit or not. USCIS will sort it out.
