I know a woman who married a United States citizen in her home country of Nigeria. Sometime after they were married but before her visa interview she found out that her husband was cheating on her while they had been living on separate continents.  Apparently, she saw pictures on his Facebook page. She claims she wanted to see if the marriage could be saved so she continued to talk to him online and by phone and went and interviewed for her visa and it was approved. However, she and her husband continued having difficulty throughout this time and he did not even assist her in getting a plane ticket from Nigeria to US. She had to scrape up money herself to bring herself and her daughter over. When she landed in the US, she was not picked up by her husband. She was picked up by a cousin who was already in the US. She didn't even have her husband's address when she arrived, but they were talking on the phone still. Her cousin and my family (although not the sponsor for her) are providing shelter, food, clothing, cosmetics and hygiene products, transportation, all guidance and support to her and her daughter. They have been in the US for a month now and she has not even seen her husband in person, they only talk on the phone as she is trying to work things out with him she says. I've learned recently that he has cheated on her with 5 women. He told her that he would give her his address when he is ready. She has received her 2 yr green card and applied for social security cards.

 

Do you think she will have difficulty renewing/extending her marriage based green card in the future?

If she gathers evidence that he is cheating and then divorces him, i think she will be fine. If they stay married in these conditions though, it may have USCIS thinking it's not a bona fide marriage.

So she wants him back just to be able to ROC without issues ?
She can divorce him and ROC on her own with a divorce waiver IF she can prove with evidence that they married in good faith.
A couple would ordinarily show a long list of bona fide evidence of joint financial accounts and a mingled life together. http://www.visajourney.com/content/751guide
I would say she needs a lawyer because the marriage seemed dead upon arrival and I doubt that the proof of him cheating would be enough.
When she will be asked how long they lived together and she says never then that does not look good, so consult an immigration attorney.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Yes, if she stays married to him.

 

Presumably, since they don't even live together at this point, she will have no proof of co-mingling of finances, no proof of shared utility bills, no proof of shared bank accounts, no proof of a shared address, no proof of shared medical insurance, etc. which USCIS wants to see at the ROC stage.

 

If her husband is not even telling her where he lives at this point, and "will tell her when he's ready to", has cheated on her with 5 other women, and he hasn't even seen her yet in person since she's been in the US... he's sending her a HUGE message that she just hasn't chosen to receive yet.

also on the outside of the packet she gives to POE officer

this does not make sense

we would need the real story to advise

many of the officers ask what address are you going to and check that with the packet

how did this cousing know to pick her up

don't forget the poot guy from Atlanta whose gf sent message in airport saying POE was sending her back and then the guy saw her leaving in another car

not knowing where he lived doesn't make sense

I think it will be next to impossible to lift conditions under these circumstances.

Wasn’t there a guy who did this about a year or so ago? Came on a cr1, changed address for the green card, never saw his wife, started drive by a taxi, everyone encouraged him to come as he said he wanted to come and reconcile with his wife. He is still here so why can’t this women if she says that she wants to reconcile and they have been talking.

Without a doubt. The marriage was DOA and if it looks to us that she only came for a GC how do you think it will look to USCIS?

There seems to be a certain desperation to remain in the USA

but under these circumstances she should put her child ahead of that nonsense and not expose the child to this man and lifestyle.

She certainly is not accepting that the marriage is over.
