Filing for citizenship while in the DEP

Hello everyone,

 

Question regarding a legal aspect of being in the DEP and filing for citizenship N-400.

 

Here is my situation: The Moment I was done with the removal of conditions and had my new green card in my hands, I went straight to the Air Force Recruiting Office and went trough the whole enlistment process.

 

Currently I am just waiting for my security suitability determination to be done and then I will go to BMT in the summer. 

 

I know that I can not file for citizenship through military service for at least half a year after starting active duty service.

 

 

However, as I am still happily married to my US Citizen wife, I can apply for citizenship shortly.

 

The question now is: Does me being in the DEP count as “being in the military” ?

 

And, am I still allowed to file for Citizenship through my marriage despite being in the DEP ? I do not want to do anything shady but if it is still legitimate for me to file under these circumstances, I would like to do that in the next days.

If DEP means Delayed Enlistment Program, then I can tell you that the military considers it as being in the military.  They used my DEP date to calculate service longevity (Time in Service) for pay purposes, promotion purposes, and for retirement purposes.

 

Disclaimer:  My military service began in 1971.  The rules may or may not still apply...lol

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

i would appreciate any helping comments in terms of if me being in the DEP changes my eligibility to file for naturalization based on the marriage to my wife who is a US Citizen and married to me go more than three years.

No, for citizenship or USCIS this does qualify to expedite your request.
