My husband made a trip back home last week, amd unfortunately experienced a mental breakdown. He has bipolar disorder, and I think being home triggered a bad episode for him. 

 

1) We haven't filed taxes yet and they are due soon.

 

2) I dont know how long it will take for him to stabilize and come back.

 

3). He has pretty much lost his job unless he comes back within this week, which is possible, but not assured.

 

4) I'm extremely worried about him as he has no home there, no income, no source of food, no way to get medical help.

 

All of these combined are terrifying me that he will ruin the visa we have worked soooooo very hard for. 

 

Can anyone explain to me what happens if he doesnt get back in time to file taxes? And does him leaving like this have the potential of voiding our visa? He has spent a total of 5 months here since we got the visa. So he hasn't even finished half a year. 

 

He says he will come back next week, but he is also going back and forth on that. At the same time, he is extremely paranoid that having left, he will be arrested upon entry. (Part of his illness) So getting him here in time to do taxes and avoid losing his job is looking to be quite iffy. 

 

How long can he stay out without causing damage to the green card?

OP, it might be a good idea to go pick up your husband so he feels more at ease returning with somebody he is comfortable with and is a USC.

Passport 17-Feb-22 Drop-off at USPS (expedited processing and shipping) ~ 22-Feb-22 Status: In Process ~ 08-Mar-22 Passport book shipped ~ 09-Mar-22 Status: Approved. Passport book in hand.

N-400     28-Jun-21 Filed online ~ 28-Jun-21 Received NOA + "Biometrics will be re-used" notice ~ 14-Dec-21 Interview scheduled ~ 25-Jan-22 Interview. Approved. Case status: Oath will be scheduled.  ~ 01-Feb-22 Oath scheduled. ~ 14-Feb-22 Oath ceremony.

6 months probably no problem.  6-12 months they'll check his ties to the US at the counter but probably still no problem.  More than 12 months they'll let him in but he might have to see a judge later.

2) I dont know how long it will take for him to stabilize and come back. That is ok, he can stay outside the US for 6 months without causing a likely issue

 

3). He has pretty much lost his job unless he comes back within this week, which is possible, but not assured. sorry to hear that

This right here. Having worked and spent a lot of time with people who struggle with similar things, having a familiar, calming presence very well may help. At least a small trip so that you can help him work through it, so he doesnt feel alone?

yes, this. While realizing it would probably be a disruption to you, surely the disruption of doing this is far less than some of the scenarios you've outlined above.

And don't stress about taxes. As already mentioned, you can do them without him, it's nearly 2 months till they're due, and/or you can file for an extension.

His green card is perfectly safe right now but given his current medical situation it would probably be much, much better for him if you are with him on the long flight to and at the border to re-enter the US.

With no food, no home, no way to get medical help he needs to get back to the US. That means you going to get him. Without medical help he will spiral down fast.
