I would like to ask if we can start to file a k1 visa. Even my fiance still has on going issues with his ex wife. Which includes family decree and he has been arrrsted for a false police report. If we file now and support documents later. Do you think it may cause delays. Or is there any other way to make the process shorten or how could it be.

Are either of you still married? Do either of you have criminal records?

 

Those are a couple major issues (if you have them). Not everyone has a happy family, and I think the person viewing your case will understand that. As for evidence, you need to submit everything they ask for, otherwise you get an RFE and that will delay things.

He is divorced already. I nevee been marey. And he dont want to delay things is we file now to start the clock. Or we need an visa experts to ask for. Thank you

Define Criminal Record?

 

For the most part USCIS and USEM doesn't care about your past criminal history if you area US Citizen. Only a few listed on 129F that you have to list or get a waiver for. 

 

 

Just when you think you have TDS eradicate,  a new case shows up.

As neither my husband and I have criminal records, I’m not exactly sure of what the parameters are within that restriction. However, I do know that they (USCIS) have a tendency to look at ‘crimes’ on the beneficiaries record more closely and that at times it can cause issues.

As someone who was specifically most worried about those very 2 subjects, I can say go ahead and file. Who knows what goes through the mind of the people judging us who have police records during processing. All you can, and what you absolutely have to do is be 100% honest on the I-129. The old I-129, prior to this years, was very specific to certain crimes only and even though applicants still had to include any arrest records, It definitely made it look like they were looking for specific types of offenders. At any rate a false police report (filing one?) seems pretty benign to me and isnt the type of thing that rates high on the radar.

 

And yes you'll have lots of time to work out the the details of support, providing you have a loose idea anyway.
