hi,

 

my fiancé has dual citizenship - Canadian & American.  I'm a Canadian.  we are planning on getting married in Canada. how soon can I start applying for a green card? will INS (or whatever agency that handles American marriages to foreigners) come visit us in Canada or will we have to go to US customs to show proof of legitimacy?

You've posted this in the K1 fiancé visa forum. If you are planning on marrying in Canada a fiancé visa is not for you - as you are required to marry in the US once you have obtained it.

Are you planning to live in the US?

we like having the option of living in either country. 

To keep your green card/status as a permanent resident in the US, you have to live in the US. First step would be to discuss where you plan to live after you get married.

You can start applying when you're in Canada, once your spouse visa ( CR1) is approved, you'll have about 6 months to move and live in the US.  You should look up TN work visas to see if you qualify - if you want to work in the US temporarily it might be a better path for you.

A green card cannot be obtain abroad.  The process is that you will receive a visa that makes you eligible ONLY when you enter the USA.
