Expedite EAD based on a successful job interview. What do ya'll think?

Well, damn... I was hoping to hear something soon, but now I know it may take forever lol. Seems like there is no way. I hope we get it soon anyway.

It is good that you can  adjust your expectations. I thought I was going to get something everyday since day 1 after I faxed the job offer. It was a miserable Jan and Feb. That is why I wanted to share my failed experience so that people know how the worst scenario is like before they make the decision of actively looking for a job.

I get it. We all gotta get through this once. Looking for jobs is great as long as employer is cool with waiting. I just don't understand the point of expeditious requests if they take months. I think if they request evidence they should make a decision quick or just deny expedite requests on the spot. False hope is the worst.

My application was received on August 2nd, I had my biometrics on August 31st. Received an RFE, sent response on September 27th. 

At the end of November I expected my EAD to arrive soon, so I applied for a job. I was offered the job on December 22nd, and requested an expedite that same day. I was never asked to fax my job offer, but when the Senator's Office got involved on January 5th they sent my job offer to USCIS with their Congressional Inquiry. I kept calling USCIS almost daily, and on January 26th a tier 2 officer finally told me that my EAD was approved. I received my card on Thursday February 1st, signed my paperwork with Human Resources on the 2nd, started working on Monday the 5th. I feel very lucky that my employer was so patient and understanding.

My employer told me that they are cool with waiting: they told me that they sponsor H1B all the time. Yet, they were still shocked by how slow my case is as another job candidate who is on H1B had already been processed.

 

"I just don't understand the point of expeditious requests if they take months." That is exactly what I said to a T2. He replied that it could take longer if it were not expedited...

 

Maybe they need to solve a trigonometry question before they process each EAD. Hahaha. Otherwise, I just do not know what they are pondering about on each case.

You case had been pending long enough though. At this point you never know what helped I guess.

I know the EAD expedite in itself takes 2 weeks so if i tell them to wait they might move on to the next candidate. But i really like this job!!! What do you guys think? Anybody been successful like this? 

 

Would this be a good enough reason to do an EAD expedite? Please help share your opinion!

 

hey! I just got approved for an expedite. It's worth a shot. If you have the offer letter you should be fine. Just make sure when you call in you are very detailed with the Tier 1 officer so that all details are reviewed.

Actually my I130 got approved. I did request an expedite tho last week.

I think there is no logic when it comes to dealing with immigration. It is a hit or miss.

I’ve been working ln HR here in the States for a while now and its at the company discretion if they wait for you or not. When you accept the offer, you have 3 business days to provide a legal proof of residency starting from your 1st day of employment. Failing to provide this within the time frame puts the company in an complience issue. (doing the background check, I9 and e-verify is part of my job function).

 

Legally, you don’t have to show proof of residency before starting to work, but the potential employer asumes that if you are in a process, is because you are legally able to work. Not disclosing your current situation in time, will make you look really bad, especially because in order to attemp to get an expedite ead process, you should bring a formal job offer. 

 

Is better for you to be upfront with the  employer and ask them if there is a possible of them waiting for you...reality is that you are still facing up to 45 days to get the EAD, without the expedite. 

 

Honesty is the best policy, so even if they take 2 weeks for pre employment purposes, they should know that you might not be able to start on a the specific date.
