Hi guys, 

 

So long story short i am a january AOS filer. My PD date is 1/2/18 and biometrics were done on 2/2/18. Since then i havent heard back from uscis at all. Statuses online were not updated either.

 

I had a couple of job interviews and in one them i was successful to go to the final stage of the interview. I got an email from the HR which says congrats you are picked as one of the 2 final candidates for the job. I feel like 90% i am going to get this job and i want to lower the chances of them not accepting me if i tell them im waiting for EAD in case if they offer me the job offer. I know the EAD expedite in itself takes 2 weeks so if i tell them to wait they might move on to the next candidate. But i really like this job!!! What do you guys think? Anybody been successful like this? 

 

Would this be a good enough reason to do an EAD expedite? Please help share your opinion!

Myself always wonder why people go throuhg interviews without the EAD but anyways, mean no guarantees on expedites so... but anyways..

 

As far as I understand, you need to supply an actual job offer from the company to even attempt an expedite. I mean I guess you can try; but USCIS probably won't accept "I'm pretty sure I'll get this job" type of thing.

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

I went to interview but I had already told them that I don't have ead, but i am close to have it if there is no problem. They accepted to wait for a while. But, the problem is uscis doesn't expedite even cases with job offer that often. I tried but they still didn't ask me to fax them my job offer, it has been a week, and I am still waiting...

Thank you for your reply! Well idk about other people but i applied to jobs so we could both work and afford the living, which is not that easy in one income. Being a bit impatient also lol.

 

Thanks tho maybe ill just try it.  nothing to loose. my ead application been pending for 45 days now.

That sucks :( You already got the job? 

 

I hope u get it resolved soon. it kinda sucks to turn down a very good job offer cuz of EAD, when you know you will have it in hand soon its just a matter of time.

Have long has your EAD been pending? Mine is 45 days now

The problem is people choose the K1 visa without realizing that they will be out of employment for weeks to possible months. And sometimes it affects them. My wife, as having worked all of her adult life, went through  the same emotions as you.

 

This is why I always suggest to people who ask to go for the CR1 instead of the K1 even though my wife and I did the K1. The Cr1 is a superior visa as it gives work and travel privileges immediately upon entry to the US.

Presumably the other person will have a notice period to work through, depends what is normal in your Profession, unusual for somebody in a job to start immediately EAD or otherwise.

I always get confused what is K1? Is that the fiance visa

 I actually am adjusting status through student. I was here on a student visa for the past 9 years. Recently got married and now adjusting status. 

I have had previous EAD before through my student status.

Well most likley if i get a job offer they would give you 2 weeks to start more or less. What if during these 2 weeks i still dont get EAD?  I guess ill just wait till when i have an actual offer in hand

Yes, it is a fiance visa.

 

Sorry for confusing your situation but anytime adjustment of status takes place it leaves people in limbo.

I applied for an expedite of my EAD on Jan 26 and all I've heard so far is "case in under review, you should keep waiting"

If you do a search you will find similar answers on recent EAD expedites. But you can always try, I just wouldn't count on having EAD in 2 weeks.

And YES and others have said.. you need  a written job offer to support your expedite request.

 

In my case I was not looking for a job, but the local architecture company contacted me when they heard I moved in.. and today I received a call from a recruiter who found me on linkedin. I was planning on starting to apply for jobs in March, but since the opportunity showed up I tried the expedition.

You will need a written job offer first. And keep in mind that even an expedite takes a long time nowadays. My expedite took 6 weeks from request until EAD in hand, and that was with the help of the Senator's Office. Hopefully your employer is patient.

Can you please share your expedite story and timeline? I submitted my request 8 days ago and faxed my documents 4 days ago after they requested it. I also had senator's office email USCIS today.

6 weeks since expedition request. Still no EAD. You and your potential employer might want to be prepared for this.

Heard some people had been waiting for more than 6 months. So they were suggested here on VJ to have a job  offer to expedite the EAD.

 

In general, maybe I suppose USCIS has laid out the rule of this type of expedition and people are just playing along.

That is a good point. We really considered CR1 as well when we were BOTH living overseas. However, the US consulate told us that the US citizen needs to establish a US domicile for the foreigner to qualify for the CR1 visa. They explained that the US citizen needs to rent an apartment and find a job in the US. Given that, we had to choose K-1 not simply because it was faster than CR1 but because we do not want to separate for an unknown amount of time and pay double rent. Yeah, there is still an unknown amount of waiting time for AOS, but at least we are together. We just stick together and try to get through the less difficult path. Really hope our EAD can be approved after 134 days of waiting and 1.5 months after the expedition request.
