Greetings, 

I need help. back in 1975 my mom brought me over from Germany with my dad, and she was on a fiance visa, since then she has only done green cards, and recently let it expire. now 40 something years later, she is having issues trying to complete this process. since the day she come over from Germany, she has been married to a veteran, who passed away, and has recently remarried. Me, her oldest son has served in the military with two separate branches. she is now having health issues, and cannot work. 

I'm trying to get her immigration issues settled. 

Can anyone offer any advice, direction and/or guidance.

Does she want to apply for naturalization?

Throughout the years she just did green card, and recently let it expire. Now she's in a situation where she doesn't have anything. She has paid and immigration lawyer in GA upwards in the amount of $3,000 to get something done.

I'm would like to know what is the easiest thing for her to do in order to get this settled. Whether it's green card, citizenship, naturalization. She cannot work right now because of all of this.

As above her actual residency can’t expire just the card that shows the proof of it, she just needs to renew her card. 

 

She can work she just doesn’t have her green card to show she can but she doesn’t need to have it just her ssn and a valid id. 

 

Personally I would get the green card renewed so she has evidence of her residency and then apply for citizenship. Only say this so that she won’t worry about not having a card.

The document may have expired, but not her status as a lawful permanent resident. There are many Green Card holders who do not renew their Green Cards 'til they absolutely need to. They absolutely need to when either (1) wanting to travel internationally or (2) having to go to the lions' den (the USCIS office). For all other purposes, work and I-9 form included, no Green Card is needed if the applicant has a valid driver's license and an unrestricted SS card.

 

Have your mom file form I-90, accompanied by a check for $540. Put a 50-cent stamp on the envelope.

No lawyer needed.
