I am completely FREAKING out over here.  We sent my form to remove conditions on the expiration day on my GC.  We did 2 day priority, but of course it arrived 4 days later.  I am hoping and praying that because the signature date on my form is 10 days prior to the expiration, and the date on the check is prior to the expiration date, that it will be ok.  I didn't even think to just attach something saying why it was being sent on the date.  Technically it was all done and sent by the expiration date 😩 It was delivered on Jan. 14th, and I'm calling USCIS every day to find out if there is a receipt number yet so that I can look it up online.  Please say a prayer that they won't make a big stink about it.  I will definitely be applying for my citizenship WAY ahead of time!

Help!!! My husband is a March filer and we received his package back  in the mail today as rejected bc I filled out one part incorrectly. ( I know ). They stapled a paper that we are invited to resubmit once I correct the mistake. 

My question is: currently the green card he has is expired and now that we have to make the correction we are outside the window which they require to apply. Can I just correct my mistake and send it back ? They also sentback my money orders, can I just resend those as well??

 I failed to apply for i-757 - Petition to Remove Conditions on Residence when it was initially due. My Green card expired on 01/27/2021. I initially applied for i-90 - replacement of Green Card in Oct, 2020 thinking that was the application required to extend my status. I recently got the denied letter that stated that I should be applying for i-757. My question is - is it too late for me to apply for the removal of conditional status? Does this mean, I will be deported? I am still married to my husband and currently am a mother to a 1 year old baby girl. Please advice.

No not deported right away. You must file an i751 application to remove the condition soon to avoide immgration court. 

 

Due to filing late you must include an explanation for filing late included with your i751 package (Joint application).

Include the fee for filing i751 + biometric fee

The i751 form filled out and correctly signed (green card holder is the petitioner and beneficiary) The USA Spouse is only the spouse

Enclose evidence of a bona fide marriage: joint tax transcripts, joint bank statement, joint lease, joint insurance, pictures with family, frend, family events, and on trips, and birth records of children together with the spouse.

Prepare a cover letter explaining what happened, with copies of the denial.  

 

It would not hurt to ask an immigration attorney to assist you with the I-751 form and the explanation letter.

Yeah, not understanding which form to file is probably not one that even an attorney can talk their way out of, IMHO.

 

I don't think the extra expense would be worth it.

I sent my package with a few days to spare and my package arrived late. USCIS were ok with that:

 

* Sunday, January 9: Sent in i-751 using FedEx

* Friday, Jan 14: Green Card expired

* Friday, Jan 14: FedEx tracking says ~"Delayed, updated delivery Tuesday 18th"  (Monday being a holiday)

* Friday, Jan 21: Delivered

* Wednesday, Jan 26: Cheque cashed (appeared on bank statement)

* Tuesday, February 1: Letter arrived in mail extending status for 24 months.

So grateful you shared this - UPS delivered our i-751 2 days after GC expired and we have been totally freaking out!
