Not sure what the question is here.   Most people on this section of the forum have applied for ROC before the cut off point. Some haven't because of one thing or another and have had to explain why they have been late with filing when they have applied for ROC.  Normally there is a reminder letter in the mail from USCIS to let you know you are due to apply.

Removal of Conditions..  TICK TOCK, TICK TOCK

 

Time to reset the tick tock clock again.   Roll my eyes.

 

GC  Conditional date:  05/26/2015

N400.  Application:      02/28/2018       

Biometrics:                    02/22/2018

 

Waiting............    Roll my eyes again :(

 

USA citizen as of 25th of July 2018. :)

I just would like to know if there were any major “hiccups” for late filers. We mailed my roc packet 10 days before my gc expired. I got it all back the day my gc expired because I forgot the copy of my gc. (Uscis stamped it and there were bar codes on some pages I believe. The whole package was held together by a metal thing on top clip, not sure if this is a good sign or nor) anyway...they received it on monday, feb. 12th.

 

I guess I just need reassurance

Wow so they sent it back as you didnt attach a copy of your GC?  Am I understanding that correctly?  If so that to me seems extremely petty and if you filed on time and they sent it back that you don't really need to explain anything to them as your postal receipt should tell them everything, that you did file on time but just simple forgot the copy of your GC.  Please try not to stress, I know its easier said than done, but from what I am reading you havent done anything wrong.

That is exactly what I do not understand. Why not keep the whole petition and send me and ref or just a reminder that they need a copy of my green card. I’m just worried that this counts as late filing now. Even thoughthe stamp on the petition when I first sent it says otherwise. I’m scared that they will deport me because right now I have no valid green card :(

No it does not act as a late filing, they should have just sent you an RFE, this wouldnt hold up in court if they wanted to deport, it would come across as such pettiness. I wouldn't worry about it, you should get your NOA 1  in a few days. Please try not to panic, youll be ok.

Hi there, you are stressing a lot. Please feel good. I believe you will get your NOA next week or sooner. Late filing is an option if someone has a valid reason. You missed out on your GC and they send the package back to you by asking for the GC copy. If they wanted to deny you they would have sent you a denial notice. This is done by applicants sometimes they forget to send some required documents and then have resent it again. You should be good. Regards

We actually filed my husband ROC the day his GC expired.  It was sent overnight so they received it one day late.  I wrote in my coverletter why it was filed late (big cross country move causing documents to be lost and a huge financial strain).  We got our NOA a week later dated the day it was received.  (see our timeline)  The ROC process took a long time because we got our first ever RFE for a lack of additional documentation after the move and also had our first interview as well.  Any delay in the process was mostly caused by us, not necessarily because we filed a day late.  He was eligible to file for citizenship while his ROC was pending, but we again couldn't do it right away.  He became a citizen last month.  6 years from k-1 to citizenship.

I’m glad everything went well for you guys! It sure is a nerve-wracking experience and I am glad when all of this is over. I think we didn’t mail enough evidence either but are prepared if we get an RFE.

 

All these horror stories you see online are probably another reason why I have so much anxiety and panic attacks

I can give you a late filing story.

 

My husband came over on a K1 and we got married February 16, 2004 (in the 90 days). We filed the forms and got his 2 year conditional greencard.

 

Fast Forward past the birth of our kid, Katrina devastating our home, 2 car loans, a house mortgage, multiple renewals of his drivers license and his steady job to 2016 when we realize we didnt file the i751.

 

Filed for it in October 2016 with a cover letter explaining on how we were moving around living with family for 7 months after Katrina (our area was deluged, the eye came right over my town in Louisiana) and apologized a lot. We had a lot of evidence of a bonafide marriage, as everything was in both our names (bank accounts, mortgage, health insurance, etcetc). Sent it all in.

 

Last week, without RFE or Interview, he was approved for his 10 year card.

 

I was just surprised we could do everything without anyone EVER asking for proof of residency (mortgage, car loans, drivers license renewals etc), so it never occurred to us that we missed a date of something. 

 

I could find very little on the internet of someone filing as late as we did, mostly people are just like a day or a week late. We were err... 10 years or so?

Yeah it was wow. If the i751 got denied, we could have done the i130 etc, since he entered the country legally and "overstayed". But our lawyer said that the i130 might get denied if we didn't file the i751 late, as they would consider us to have an open i751 case and not eligible to apply for i130 until that was resolved. Luckily the i751 worked!

 

I was most surprised about the Drivers license. he last renewed his last year. Just walk in, hand them old Drivers License and they took his picture and gave him a new one, even asked him if he wanted to register to vote.......

Hi did it get approved on time? 

My hubby 's green card is expiring on the May 14th. I have sent package on the 23rdof April and was received the next noon. They didn't take money out of account yet. Didn't received any letter from USCIS yet.  Getting worried now.
