Hi,

Today my husband just from the court to removal proceedings formally terminated or dismissed . But the judge didnt do it , the judge said new regulation no more or not allowed to do removal proceedings.  My lawyer told judge if he didnt do removal proceedings once my husband leave and attend the interview at abroad USA Embassy he might be  not allowed to enter USA anymore . But Judge answer ' what are you worry for ? You have approved I~601a , thats is already enough .

His interview schedule is February 26 '18 , what shoud he do now ? Should he leave and attend the interview ? Would that be high risk if he leave the USA ?

Thanks

Can you please give us more details why he is not eligible to adjust the status in US and which country he belongs to.

please update your timeline also. when I-130 is approved, where is the interview location etc.

thanks,

Hi ,

He supposed to have removal today, but judge doesnt want to do that because he said theres new law . The judge only explained there is new law which is not allowed to do removal proceedings.

He went today at New york . And judge told him few days ago theres 7 or 8 people also cant do removal .

other then that judge didnt mention anything .

Is that right there is new law about no more removal proceedings ?

Judge only said no need to worry , because my husband already had i601a . So abroad US embassy not gonna give him hard time , and when he arrive at USA shouldnt be have a problem . But who can guarantee that?

He will have the interview at Guangzhou china USA embassy on feb 26 2018 .

Should he just go to guangzhou or no ? Lawyer doesnt allowed him to go  because hes worried cant enter USA anymore .

I~130 was approved few years ago

Thanks

Hi, I don't know about the new law. I search but didn't find anything , may be a moderator may put a light on it. If he came here on any visa (checked at POE) then he will be eligible to adjust here otherwise he have to attend interview at home country.

I think your lawyer might also worried, as he didn't know about this new law.
