Hi all,

 

PD 04/11/2016 F2A GC father sponsor unmarried children under 21 (lives legally in the US since then). We have been submitted AOS through USCIS few months ago. From March visa bulletin, look like the final action date will be in April for April visa bulletin, meaning visa is available.

 

What is next? Are we expecting the interview letter in March, or it would take few more months to process AOS?

AOS can take anywhere from a few months to over a year to complete, depending on the local USCIS field office. Most take in the ~6-10 months or so range the last time I checked.

@geowrian. Is this gonna be the same process as 10 year GC (for spouse) and they will decide whether the interview is needed or GC will be sent to us directly?

 

@Hassan Jadoon. DOB is 10/06/1997. I hope you are right :) IL will be sent end of Feb.

The process is fundamentally the same, except with showing evidence of the father-child relationship instead of bona fide marriage evidence (typically via a birth certificate, although sometimes via a DNA test if there's a potential question of paternity...they would ask for this is necessary).

I believe an interview waiver is available - at the IO's discretion - for a minor child. It's been too long since I looked up the exact rules for interview waivers. :P

I also have a friend who also sponsor for her child-under 21 (Outside the US) through NVC. Same PD as mine, April 2016. However, They already have received interview letter for April 24 2018.

What am i missing here? My daughter is in the US and we submitted I-485 in October 2017, and i assume our case would be faster compare to whom staying outside the US and have to go through NVC.

 

I'm really frustrated at this time. Please help.

You're comparing 2 very different departments. There's no practical basis for AOS (in the US) to be faster than consular processing (abroad).

AOS is handled through USCIS (DHS). Immigrant visas are handled through NVC then the embassy, which are both under DOS.

Even then, the specific local USCIS field office (based on where you live) is the biggest point of delays for AOS, whereas the consulate can be the biggest delay for consular processing.

Thanks @geowrian. I was doing research about the timeline between USCIS vs NVC and was thinking USCIS would have done a better job :)

So i guess even the visa is available for my daughter (according to April Visa Bulletin) we are still waiting for the decision on I-485 (which could take to 10 months)?

She will soon turn in 21year old on October 2018, when do you think we need to consider for CSPA submission? Or i guess her age will be frozen in April ( when her visa is available) and so no CSPA is needed?

Anyone else is having a tough time to wait like my case? Visa available on April 2018 but still have not heard anything from USCIS :( My daughter will soon to be 21 year old in October this year.

I'm so frustrated.

Hi All,

I received an email from NVC with the subject: Your immigrant visa case was expedited.

Can someone please explain to me how this happened since my daughter is in the US and we applied through the USCIS.
