Not amended but for example you're not allowed to shout FIRE in a crowded area when there isn't one to induce panic.

Did you read what I posted earlier? There should have been a hit on his name placed if he had issues like that so that it can not take 1 hour to get the NICS and yes it takes about 30 minutes to an hour, but several days to determine a Yay or a Nay. That's why a lot of shops will ask you to fill out the paperwork first before you decide which firearm to buy.

That is a SCOTUS interpretation.  Go back and read up on the 2nd, there have been a lot of SCOTUS cases interpreting that amendment.  In fact, most of the amendments have been interpreted over time by various SCOTUSes with the possible exception of the 3rd.

you were talking about handguns and california..didn't see how it applied to the topic at hand.

You are actually. Perfectly legal for you to utilize the first amendment to shout whatever you want in a crowded area. However, there are consequences for doing so.. such as being arrested.

While taking a while to purchase the gun you wanted was likely annoying to you, I find it reasonable to me. You still got the gun you wanted in the end. But that was a different state to Florida, and they have very different rules I would assume.

He had never been arrested - he had 'talking to's' by the police.

He had already had a long history of bringing weapons on school property, however never arrested.

He legally purchased his 'long guns', however the hand guns he also had would be questionable - Florida lets you buy long guns at 18, but makes you wait longer for handguns.... I don't want to conclude that the Nazi group perhaps provided him the rest.

He posted disturbing stuff online and said disturbing stuff to people but never did anything provable to anyone... but animals... don't think that's going to show up.

He threatened people but I don't think the kids filed a police report nor the school either, nor did they put him in a psychiatric hold.

He was kicked out of school.. but I don't think that's going to show up either.

He supposedly went to a health clinic for mental stuff over a year or two ago, but he was never sent to a mental hospital or had a hold placed on him (does walking into a clinic and talking to a councilor show up? didn't think so).

I have always been ok with someone that has been adjudicated as Mentally ill not being able to own firearms IF they pose a risk to others. The only issue with that is some states that into account that some of us Vets like myself have PTSD and use that to take someone's guns away. The key word is ADJUDICATED which means actually DIAGNOSED with it.

 

I do have a real life scenario where my former coworker who has been to Somalia and actually wounded there had a mental breakdown the beginning of January, he had to be brought to a VA Mental Hospital for a couple days because "the skinnies were going to get him and me". So they 6109'd him and took his guns away until he seeks treatment and gets a court order to get them back.

I NEVER SAID ANYTHING ABOUT A HANDGUN IN CA. I was talking about how the process went when I bought my AK-47 in CA, and how some states have different laws to follow.

That right there is a big issue. If he had a pattern of doing this then yes he should have been arrested for doing this. That would have initiated a paper trail on him even if it was a misdemeanor.
