Timeline

Why do some people have to remove their conditions I-175 and some don't.  I have been told I do not have to do it.  I came here on a IR-1 we have been married 17 years.

CR-1 is for people married under two years. At that point you get a conditional green card, which needs ROC after the 2 years.

 

IR-1 is for people married over 2 years, you get a 10 year green card, meaning no ROC.

 

ROC applies also to people with K-1 visas as they get a condition GC after AOS.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

If you become a permanent resident through marriage but have been married for less than 2 years at point of application, then you receive a conditional 2 -year green card and must remove the conditions at expiration or 90 days beforehand.
 

05-18-2022: Filed N-400 online. Received online NOA and Biometrics re-use.

06-03-2022: Interview scheduled (online notice).

06-10-2022: Interview letter received via USPS.

07-11-2022: Naturalization Interview

This is incorrect.  IR-1 status is determined by date of POE, not application date.  So if the spouse enters the US after 2 years of marriage, IR-1 would be appropriate, regardless of the application date.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You entered the US on immigrant visa (such as IR1 or CR1) after you have been married more than 2 years so you don't need to worry about removal of conditions (ROC).  Enjoy!   

 

Some people, who entered the US  at the port of entry (POE) on CR-1 visa after 2 years of marriage or on 2nd anniversary date, got I-551 stamp with IR-1 at POE so they don't have to worry about ROC.  but you got IR-1 visa because you have been married for more than 2 years.

 

You are eligible to apply for US citizenship if you meet N-400 requirements (For example, be a permanent resident for at least 3 years immediately preceding the date of filing N-400, be 18 or older, have been living in marital union with the same U.S. citizen spouse during such time, etc).

Yes, you were.  POE date determines whether the immigrant is given CR-1 or IR-1 statusThe date of application is irrelevant....

The same would be true.  If a K1 or AOS from another visa received their green card after their 2nd anniversary, they would not need to remove conditions.  Some people do this on purpose. :huh2:
