Hi there!

Right now my husband(USC) and I are living in my homecountry therefore he has no job in the US at the moment. 

 

We were planning to have his mother be our co-sponsor and were wondering how much money she would have to make?

I know it‘s 125% above the poverty guidline but I really don‘t quite get what this means?

Also do we have to count in everyone who is living in the same house as my mother in law?! 

We‘re struggling a little bit here and would appreciate any insight and help!

Maybe this will provide a little help:

 

" You must count the sponsor, the sponsor’s spouse (regardless of where the spouse is residing), the sponsor’s unmarried children under 21 (regardless of where they are residing), anyone counted as a dependent on the last tax return, the intending immigrant, and any derivatives who are accompanying the principal beneficiary. The term “accompanying” means they are immigrating at the same time or within six months of the principal beneficiary.  "

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Her husband and Only that persons can be count in her household size that she has mentioned as dependent in her tax return plus all those people are also to be counted to whom she already sponsored and they didn't get citizenship yet.. its my understanding

Not sure if your mother's partner is counted or not, but here's how it plays out under both scenarios.

 

Your mother's partner is not counted, household size = 2 (mother + immigrant). Required income: $20,300

 

Your mother's partner is counted, household size = 3 (mother + partner + immigrant). Required income: $25,525.

 

Things change if you are active duty military or if your mother lives in Alaska or Hawaii, but for the most part this should be accurate.

06/24/2017: Mailed I-130

06/27/2017: NOA1 (technically a RFE as we were missing beneficiary ID)

07/06/2017: NOA2

07/12/2017: Case assigned by Juarez embassy

07/17/2017: Packet 3 received

08/15/2017: Interview/Approval!

08/22/2017: Visa received via DHL

09/03/2017: POE

09/16/2017: Permanent Resident Card received

 

Total days from NOA1 to approval: 49

You do not have to include your husband unless he is under 21 and unmarried (obviously not since he's your husband) or if he was counted as a dependent on his mother's tax return. This is highly unlikely seeing as how he's married and living with you in another country.

It's 125% "OF" the poverty line, not 125% "OVER" the poverty line.  Very different.  "Partners" are not household members in this context and neither are US Married Children.  The OP's husband is his mother's married child.

Hey I‘m back on this topic as we‘re preparing everything for the NVC stage now

 

So, just to make sure, here is our little...scenario and I would appreciate your confirmation or help if I‘m wrong 🙄

 

My husband, the petitioner, lives abroad with me.

He has a daughter who lives with her mother in the US and who he pays child support to

As my husband is abroad and doesn‘t have any income we asked my mother in law to be our joint sponsor

She is living in the US in a house with her partner (who is still married to another woman) and her father ( so my husbands grandpa) 

We do intend to live with them for a short period after we get back to the US

 

Am I right, that my husband fills out the I864 and my mother in law fills out the I864a

 

And for the income requirement we count, My mother in law,my husbands daughter and Me the beneficiary! because nobody else is counted as a dependent ?!

 

Please let me know if I am right with this or completely wrong I feel like we have read the instructions over amd over but the more we read the more confused we get!

Any help is appreciated!

"Partners" only count if married to the joint sponsor.  Your US Citizen spouse is NOT immigrating so is NOT counted in the mother's household.

No.  Both your husband and his mother complete separate I-864 forms.  They are NOT combining income and are NOT in the same household, even if you WILL stay there for a while after you immigrate.
