My papers/documents couldn't fall out either but the embassy still told me that I had to come back to reseal it.

Not really. They obviously do it because they don't want to take the risk of people being denied entry when they come to the US. 

Just because documents cant fall out, doesn't mean that people cant pamper with the documents. This is just my guess though.

How do you know....? The embassy would obviously only address it if you contact them and tell them that "Hey, I got my visa package today and it was ripped". Or else they wont know. I am sure that a lot of people receive it with small rips and just don't bother in contacting the embassy.

Was your pack broken? Did you contact the embassy and they told you that resealing wasn't necessary? Then it probably wasn't. I sent them a picture and they told me to bring it in for them to reseal it. While there, they told me that it is veeeeeeeery common that people have to come back to reseal it.

If you contact the embassy and tell them the package is ripped open at all, they will almost certainly suggest bringing it back in to be re-sealed. They don't have a way to know the state of the envelope without looking at it in person (even a photo is questionable if the low level employee knows what is fine or not). CBP is the one that cares, and so long as the contents cannot be tampered with, it's fine. A small cut in the corner is normal so both you and airport security can see what is inside.

Applying for anything is always an option, but no other visa would be granted.  The next time he travels to the US, he must enter as an immigrant and the petitioner must enter at the same time or before he does.
