Travelling to US before petitioner

My husband has been approved for his CR1 and we are planning to move the The US in May. Prior to May my husband had planned to fly to the US for my brothers bachelor party (without me) and a month later we are both going to my brothers wedding and then the month after that we are planning to relocate permanently.

 

The letter we got with the visa packet says “you cannot travel to the United States before your petitioner has traveled to take up residence. You must travel at the same time or after them" - but this travel is not to take up residence but a quick visit.

 

can my husband travel for my brothers bachelor party?

 

My second question is - there is a inch long tear in the upper right hand corner of the "Visa Packet” Is this tampered?  If so we are supposed to contact the embassy which we have but he’s due to travel in 2 days and they haven’t responded.

What visa is he planning on entering on? If his immigrant visa then no, that wouldn't be allowed. He may well be turned around at PoE and returned to his country of origin, since it directly contradicts the instructions you yourself stated, where he can only enter with or after you.

1.  You must enter the US with or before your husband.

2.  Sometime the packets have a corner cut which allows officers to see what is there.  My wife had no problems when she arrived with her package which was missing a top corner of the package.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It states that YOU must travel to take up residence before he can enter.  Therefore, he can not enter the US via his immigrant visa before you return t the US to take up residence.

Very similar to my wife's package.......on her package, the top right corner was cut, exposing the top right corner of the documents inside.  It looks fine from what I see.

It's supposed to look neater than that. I doubt it will be an issue, however, for a small tear like that.

I saw. I was thinking that applying for a new tourist visa could be an option. Not in time for the party, but possibly for the wedding. OP also doesn't mention which country so unsure whether they're eligible for ESTA or more likely, a formal tourist visa.

Maybe somebody lost the only pair of scissors at the embassy. ;)

 

They almost certainly will not issue a non-immigrant visa with an existing immigrant (unendorsed) visa in the passport.

That's correct.  If he had a B1/B2 visa, the consulate will cancel it "without prejudice" when CR1 is issued.
