Affidavit of Support - Bonuses??

Hello all!

I've searched and haven't been able to find an answer for this.

We're preparing the affidavit of support for my hopefully upcoming interview (had some trouble getting through NVC not sure where it is yet because they got my birthday wrong so hopefully they've changed it but who knows omg) and there's just one thing that's throwing us through a loop.

So, my fiance in America makes $15/hr and works a 32 hour week. I've worked out that this is $24,960. Great, over the 125% poverty line, wonderful.

However, he gets performance based commissions/bonuses whenever he upsells a customer or meets certain goals (he's a call rep for IBEX global operating for Frontier, so internet and tv packages and the like).

We're planning on giving recent paystubs and a letter from the employment stating his hours a week and hourly rate, but should we ask them to factor in the bonuses in anyway? And how should we factor them into this year's projected earnings if he doesn't know when/how much they'll be?

you would not need to get a letter from employer if you have the last filed taxes returns so show the income.

Last years income is very different because he switched down to part-time this year. I was told it's about current earnings, not past earnings, which is why we need the more current confirmation from employer.

Current earnings are important but most people use tax returns to show earnings capacity...  Current earnings and employer letter is typically used if the historical look is lacking and/or there has been a significant change that increases the current earnings not previously demonstrated by history

Well, he went from full-time to part time, so his sarlary HAS significantly changed.

But has he fallen below the line when considering all the streams of income?

most take in the current year tax return that was filed and W2, as well as past returns to show a consistent history of income. 

 

if his part time status still doesn't make him fall below the threshold, I would not worry to get letters and pay stubs from his job

Also, the threshold for the I-134 is 100%.  125% is used because the window between the I-134 and the I-864 for AOS can be pretty short

But the amount of people who have had 221g's handed to them because CO's go by the rule of "if you don't have it now you won't have it then" so I'm not risking that.

He didn't work for a lot of last year, so his W2 won't come up above the threshold.

I don't know, just going by general knowledge. But that's besides the point. He makes the 125% without bonuses, that's not the issue. Last year's W2 won't come in above the threshold.

You are now at the London Embassy...  general knowledge is out the window because each consulate has there own way.  You want London specific answers here.  My recollection is that London is fairly tame on the financial support affidavit issue

I heard that as well. I'm going to start a thread in the UK forum, which is what I should've done originally. :P
