Hello All,
I have this question for which i am unable to find a definitive answer.
 
My mother received  her green card via me in 2016, and she will need to travel back n forth from India to USA for another year or so, she stays 6 months in India and comes back.
this is based on 6 month rule, i.e. can't stay outside US for more than 6 months and re-entry permit is required if stay is longer than 1 year.
 
Question - 
My mother had to go to India to attend some family matters, can she stay in India for like 11 months but not cross 1 year mark?
will there be any issues at immigration when she comes back within 1 year?
 
Anyone of you have experienced this case?

theres always that possibility that they can question her when she comes back... happened to my Grandma when she was a GC holder... she was doing the same thing till they cought up to it and told her that she will have to prove strong ties to the USA next time she went out of the country for that long....she got nervous about it and waited till she was eligible for citizenship and became a citizen 2 years ago!

Yeah, this rule is very selective and no where it is written clearly about it.

I will extend her stay for this time by 3 months (less than year), and she will then stay back longer to avoid this situation.

A person could say it seems like she is trying to live in both countries.  She should expect to receive some scrutiny.....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Why would she need to do that? The United States is supposed to be her home, her primary residence. Why does someone who lives here need to spend so much time elsewhere? A green card is for living here, not a deluxe version of a tourist visa that allows her to live in India and come here for a few months each year on vacation.

Leaving the US is never the issue....the sticky part comes with re-entry.

 

I was questioned at the US border for only a 60-day trip to my home country----all depends on the officer she encounters at POE as to whether she will be scrutinized/verbally warned/etc.

Even trips under 6 months can be determined to be seen as abandoning LPR status (especially frequent longer trips).

I was told at my GC interview I couldn't be gone longer than 6 months at a time as well as my trips combined couldn't total more than 6 months in a year. 

 

However, I think you can apply for something that would give you access to have that length extended.  Your mother could always make an info pass appointment and speak with USCIS directly for more information.
