even if NVC has no issues there could be issues in future, your husband needs to go back and Ammed every return he filed as single when he was actually in fact married.

This is bad, he needs to go back and ammend his return, if he doesn't want to file for ITIN for you, and clearly you don't have a SSN yet, he needs to ammend to married filing separate returns, and do it by hand, and write NRA in the ssn field, and mail to IRS. you can not in any way file single if you were married as of the last date of the year in which your filing for.

I know sir we should file as Married File Separately. but as u said amended return will take too much time that's y i m worried and hv seen in many cases where people just file as single and go through the process.

Yeah but one member is saying amendment of tax would take two month approximately and my interview may be schedule before irs response. My case completed at 12th of January

even if it takes 2-3 months for IRS to acknowledge you can take a copy of the amended form with you to the interview, at the point they ask you for a copy of the tax return, you present them with the one orig filed and the amended form together.

 

yes it takes longer for IRS to acknowledge but as long as you have a copy of what was filed you are fine.

Your are quit right but IRS gave u Three years of time in which u can amend ur tax returns. For sure we will amend it but at that stage if we send it as single what u  think sir it would be denied or ask for amended one?

according to your time line your interview was last December, It might not cause a denial, but filing as single on a tax return when you are in fact married could send red flags with the interview.

hmm it's true we or going to send it at US embassy. that's y m worried a lot because amended tax returns can cause more delay in our case.

An incorrect tax return is not a reason for refusal in itself, but

1) Can be a factor in the CO's decision if the marriage is bona fide or not, and

2) Can cause the I-864 to not be accepted (which is required to issue the visa)

as long as you present the old return and the amended return together, this will not cause the case to be delayed, as there is an explanation of misunderstanding when the orig was filed.

you want to have as much bona fide proof as possible, and having a tax return as single is a big red flag.

 

I know this process to bring our spouse here is stressful, and trying, and hard

I know but the sooner it is fixed and you have the copies, the sooner you can breath easy, and its a simple fix.

 

once you get the papers from the fix you can breath easier.

OK...here's an issue:  my wife has no SSN yet.  She also has no ITIN.  We have just been forwarded to the State Department, so she's "eligible" for a green card.

 

After answering some survey set, the IRS says this: "An Individual Taxpayer Identification Number cannot be issued because you appear to be eligible for a Social Security Number."

 

Does anybody have any insight?  I'm at a loss right now.
