RFE question

i just got an rfe today, here it is.....

You are ineligible for interim employment authorization pursuant to Title 8, Code of Federal Regulations, Section 103.2(B)(10)(ii) until (90) days after the missing intial evidence is received.

F. x (4) Submit a completed and signed Form I-864, Affidavit of Support (or Form I-864EZ if applicable) for the petitioner listed on Form I-130 or Form I-129f. The petitioner must submit For I-864 and supporting documents even if a joint sponsor Form I-864 will be used.

We submit Affidavit of support but it was Form I-134...what is Form I-864? does that mean that we need co-sponsor? my husbands income is above poverty guidelines....

what about work permit? are they gonna issue me after i submit the rfe?

The I-134 is for the I-129F finacee visa process. When you apply for AOS you need to fill out the I-864 instead. It does not need to be notarized but is slightly longer.

but another question...we dont need to submit form I-864EZ if i already have form I-864 right?

Has the requirement for the I-864 changed? When I filed for AOS a while back we had to have our I-864 notarized.

Yes, the I-864 has changed. The interim guideline that was in place for some 7-8 years was finally replaced with a final guideline, which has some significant changes.

question again please.....do we still need to include the W2's, ITR's and employment letter even if we submitted it already? thanks all

My advice would be yes - submit everything again. You need to submit each form as a complete package. I would not think that an adjudicating officer will want to spend his time pulling paper from one package to place in another. I definately would not assume that they would be willing to do this.

yes

send a complete new I-864 package including all it requires. just to be ont he safe side.
