I’m applying for naturalization based on the 5 year rule. When I changed jobs in 2014, I had a 2 week gap between the end of the previous job and the start of the new job. I was relocating across the country and wanted to have some time to settle in etc before starting the new job. Do I need to report the 2 week period as an unemployment period? The online application system does not allow gaps in the 5 year period.

Thanks in advance.

Yes, enter it as a period of unemployment. It won’t hurt your application, and you were technically unemployed during that time.

Is your timeline updated?

I have an unemployment question. Any help would be greatly appreciated!

I am filling N400 and got stuck on employment history.

How do I report the employment history due to an overlap between a part-time position and receiving unemployment insurance benefits from dept of labor?

I am doing a part-time job since July 2017. Due to the loss of my previous full-time position I received unemployment benefits from dept. of labor from Feb 1, 2017 to November 2017.

Which way do you think is correct for me to fill?

1.       July 1, 2017 to present – Part-time position

Feb 1, 2017 to June 30, 2017 – unemployed

Or should I fill the total time I received unemployment benefits as unemployed like the following

2.       July 1, 2017 to present – Part-time position

Feb 1, 2017 to November 30, 2017

Please let me know your suggestions!

Thank you

I would fill it out the first way (#1) - in the application somewhere, they ask separately if you received any government benefits - like TANF, unemployment, etc.

My bad.

Thank you both for the replies. So what would think the best way to report in this overlap situation?

1. shows both cases

2. shows the entire time I received unemployment insurance (it is legal to receive benefits after you disclose every week to dept. of labor that you are doing part time but not earning enough)

but then can I really say I was unemployed since July 1st to an examiner in USCIS but an officer in dept. of labor clearly knows it.

Given that RFEs not going to be issued after Sep 11, 2018 and they can directly deny the case if necessary information is not given. But at the same time I do not want to give more than needed and to confuse the USCIS officer.

Please let me know what to do

select 1 or 2?

I still say 1 - they want you to account for what you were doing - school work, unemployment.

How about I say part-time employed (Job title - part time) and fill in like 1. I showed a simplified version here. My actual situation is much complicated as some times I had multiple part time jobs and those times did not collect benefits as it exceeds weekly limit. That's why my benefit period extended to 10 months.

Account for all the times you were employed - all full time or part time employers with start dates and end dates.  Account for all the times you were in school or unemployed.

What they care about is you are able to account for all the times you were in the US.

Does that make sense?

Got it, Thank you!

Dates will naturally overlap if you had multiple, concurrent (all happening at the same time) part-time jobs or had a full time and a part time job at the same time.

I have had two jobs from 2011 to the present - completed a 2nd degree and a certificate online during this period as well. (at one point I had a full time job and two part time jobs (not recommended for the faint of heart lol - overall a bad idea, but necessary at the time)

Tel me about it. I know how painful from my own experience. For the last 18 months there is nothing I haven't done. Unemployed, multiple part-time positions. Finally, I decided to change career, from the last bit of savings decided to go back to grad school. School almost coming to an end and had gone for many interviews no luck. But just an hour a go got the phone call I was  waiting to hear for a long time. After all the ups and downs in life, got an  offer for a full time position!!!!!!

Now I wanted to ask another question and let me know your thoughts.

Last week I was eligible to apply for N400. But as you know I did not have a good income at all. But 3 weeks from now I am starting a full time position will all the benefits. Should I wait until that date comes so that I can put my full time position in the employment history? If any question arises I can say that I will not be a burden an have proof in hand. Will that help in anyway (I mean waiting job start date to apply for N400)

Thank you!!

Sorry - I was out of town! Yes, I agree - even though you were legally receiving benefits, you weren't unemployed for that period, so I'd go with number 1
