Hi everybody,

 

My fiancee and I sent in our petition late September of 2017, received NOA1, and are currently waiting for NOA2.

 

I am the American petitioner and have just received a full-time job in America as of February 1st. Hourly pay is 16.50 with 36 hours a week. That totals to around $28,500 yearly. Last year I made less than the poverty line while living overseas.

 

My questions are..

 

1. Will an employment letter and a few pay stubs be enough to satisfy Affidavit of Support requirements (125% of poverty line)?

 

2. I have no income for the last year (2017) while my fiancee and I were living overseas. Can I submit a written letter that explains the reason for not filing for that tax year? Will this affect the decision to grant K1 Visa even though I have a full-time job in the states now?

 

3. Documentation required in addition to the I-134 are tax returns and transcripts from 2015, 2016, 2017 and also bank statements. Is this correct?

Answering to your questions:

1. Will an employment letter and a few pay stubs be enough to satisfy Affidavit of Support requirements (125% of poverty line)?

I'm in kind of a similar situation - in my case employment letter and foreign income was not enough to become a sponsor.

But each case is different, so who knows if USCIS will accept it.

What is especially important for them, is the total income (line 22) on IRS form 1040.

Do you mean that you had some foreign income, but didn't have any income in the US? If you had foreign income, then you probably should file your tax return.
