Do i have to make appointment in manila Philippines  us embassy for this legal capacity of marriage or can i get it in the us before i go there

One more thing to note:

Some cities do not accept the Legal Capacity to Marry affidavit,  you need to verify what the requirements are for the city you are where you are getting married.

For those that don't accept the affidavit you will need a CENOMAR same as the Filipina.

I believe the consulate in Cebu will notarize this as well if Cebu is more convenient

Have you known someone who went there or read about it?   I was thinking Cebu would be an option, but can't remember anyone who said they went there on this forum.

You need to make an appointment online for Manila I have heard you could walk in at Cebu and it is also stated on the website

and Hank is right some places require the cenomar  for you as well . You can order that online also. When I got married there I order my and took it with me but was not ask for it

The Philippine Government requires all foreigners to provide a “Legal Capacity to Contract Marriage” from his/her embassy before filing for a marriage license.  Below are the instructions for applying for the U.S. Embassy’s version of that document.

Obtaining a Legal Capacity to Marry in Embassy Manila are by appointment only. Please read the rules and regulations below and make sure you are connected to a printer before booking your appointment.

U.S. citizens seeking to obtain this service may do so at the Embassy in Manila or at the Consular Agency in Cebu.  Obtaining this document at the Embassy is done by appointment only.  Please read the information on our web site before booking your appointment.  The Consular Agency in Cebu offers notarial services on a walk-in, first-come/first-served basis each day from 8:30 – 10:30 AM.  Visit the Agency’s web-page for more information on service at the Agency.

For legal certificate of marriage just show passport and divorce papper? I was divorced last month. Also divorce 23 yrs ago. Need show that one also?

I brought all my paperwork with.

When you get there you fill out an embassy form with marriage and divorce dates and submit it and then pay at another window, then wait.  They call you up and have you swear in that the info is true, then they sign it.  They never once asked for any of my divorce records.

Embassy doesn't want the divorce decree, you are simply signing an affidavit where you swear all to be true and they notarize it - that is the jest of it.

As noted by jskibo you will need the dates for previous marriages, divorces, deaths
