My fiancé has been living with me for the past 2.5 months and is leaving tomorrow before her I-94 expires. She is going to Thailand for a month and then Russia for a work trip. Would it be possible for her to come back after that for another I-94 since she’s leaving the continent (not just going to Canada or Mexico)? If so, will that cause us any problems? She works online as a freelancer and can prove that so she’s not working here illegally or anything. She would go back to her home country after we get the NOA2 to prepare documents and do the interview.

Multiple visits have zero effect on the K-1 as long as she abides by the I-94

Thank you for the quick response.

 

So, our plan would be completely okay? We would make sure she doesn't overstay. Is there any chance that the multiple entries would also help our case showing that it is a bona fide relationship? 

Also, nice to see another Minnesotan. I'm in Minneapolis. Very happy to have the whole Superbowl thing over with.

Your plan is ok as long as the CBP allows her to enter the next time she comes to the USA.

 

I can't imagine her staying with you would hurt your case

Ok, thanks. She didn't have any problems entering this time and she wasn't even questioned on her return ticket except by the airline. 

 

I imagine so, too. I just didn't know if they would find it suspicious for some reason, but I suppose as long as she's staying within the rules of the I-94

Next time might be different since she is coming back fairly quickly after a 2.5 month stay...  Rule of thumb has always been 2 days out for every 1 day in

It really depends on how many trips she's made to the US. Was this her only visit in the last 12 months? The more time she spends in the US the more it will raise a flag when she enters. It's also the luck of the draw in who she gets at the POE.

I spent a lot of time in the US in 2016 and 2017 and on my third entry I did get pulled into secondary and they searched my phone. Their main concern was how I was supporting myself and if I was working illegally. I wasn't so they let me in that time but told me I couldn't return for a while. 

 

I haven't returned since we submitted the i29f.

 

I included my i-94 record and it didn't hurt. Got noa2 on 31st January.
