The Immigration Guide for Adjustment of Status for K1/K2 visa holders needs to be updated on this website!

You NEED to include TWO copies of your marraige certificate when sending your I-485 and I-765 packet.

We received an RFE because of this and need to wait another 3 months before getting work authorization approved.

Your I-765 and I-485 will be split and sent to different processing centers.. so they need more than just one marriage certificate.

I hope someone reading this can change "A" copy to "Two" copies of your marraige certificate on the immigration guide for AOS K1/k2.

And I hope this prevents others from receiving an RFE like us! Good luck!

A marriage certificate isn't a required document for an adjustment applicant filing their I-765 using the eligibility code C-9.

Your situation must have been different than mine. To be safe if you are reading this and haven't sent in yet, you should send two copies of your marriage certificate to be on the safe side.

I'm not sure why you guys are trying to aruge with me. I was posting this to try and be helpful to others in the future.

We received an RFE requesting a copy of our marriage certificate, specifically for the I-765.

If we had sent two copies of our marriage certificate then theoretically we would not have received an RFE, and would have received work authorization quicker.

Therefore, I'll say it again.

Do you have a copy of your application form? Check that you put in c9 into the box for answer 20? If yes, then you should not have been asked for another marriage cert. Sometimes they lose one and ask for another. Sometimes they make a mistake. But the current instructions from USCIS itself do not require more than one marriage cert for eligibility under C9 - however, there are other categories where one is required.
