EAD Rejection

Timeline

My AOS, AP and EAD documents were recieved in Chicago on April 20, 2007. Today I got a my NOA1 for the AOS and AP but a "Rejection Notice" for the EAD. My check was attached along with the message "Recently you submitted an application for immigration benefits. That form was submitted with an extra remittance that is not required to process your application, or the incorrect fee was submitted. Your check is being returned to you along with this notice...."

I am looking at the check right now and its for $180 made out to US Deptartment of Homeland Security. I tried to look it up online but the receipt number is the same as our AOS receipt number.

Any help please! How can I fix this so that we get our EAD :help:

Just wanted too add the the Rejection notice is dated April 25, 2007, and our NOA1 for the AOS is April 26, 2007. Do you think they thought we were filing for the EAD without AOS? Should I just send all the stuff back with a copy of the NOA1?

How many checks, in what amounts, did you submit with this application package?

Did you get the I-765 application back along with the notice and the check?

I submitted 3 checks:

395 for AOS

170 for AP

180 for EAD

I did not get I765 application back. It is not even indicated on the form that the Rejection Notice is for the I-765, I only knew because I saw the memo portion of the Check.

Interesting. Have you received a Receipt Notice for the I-131 application?

As a practical matter, as things stand you are not out any money for the I-765 application and your objective is to get your EAD as soon as possible - yes? While it might be interesting to find out what went wrong here, if it were me I'd submit a new I-765 application without waiting to find out what's going on with the old one.

Yes, we will send out another copy of the 765 tomorrow. I got the NOA1 for the 131 today with no problems. I called the USCIS and the women thought it was very strange that the NOAs for the I-485 and the rejection for the 765 had the same receipt number.

Do you think an infopass would help?

It might or might not help finding out what the original problem was. But I wouldn't waste my time and I wouldn't wait on an InfoPass appointment to submit a new I-765.

The would not have your file at a local office, therefore it would probably be a wasted effort.

I would follow Yodrak's advice.
