Hello Everyone,

Reading the instructions for form I-129F, it states that you may file this petition if: You have filed or are filing Form I-130 on behalf of your spouse and wish to have your spouse enter as a nonimmigrant to await the immediate availability of an immigrant visa and to file for adjustment of status.

Am i supposed to file form I-130 at the same time as the I-129F? I was under the impression that the I-130F comes after my fiance is already in the US?

help. im confused.

If you guys are NOT married and plan to marry in the US and have your fiance stay, then you file for I-129F. If you guys ARE married, then you file for I-130.

that makes sense. the wording confused me. thank you.

It's confusing in the sense that in the olden days the I-129F was used to petition for a K-3 for a spouse in addition to the I-130, but that just is not a relevant path anymore

YMMV
