For the past 1 year, I was working on EAD for my previous employer on W2. Now, I am starting on a new project with another employer but on 1099 (Independent Contractor).

 

1. As per USCIS, is it legal to work on 1099?

2. Is there a USCIS requirement that I "must" be a full time/permanent employee and cannot do part time job (20-30 hours/week)?  

 

Note: This is my only job and also my job description has not changed.

Working means being compensated for services rendered...  W2 or 1099 is not a determining factor of whether you are working.  Even if you have EAD you are not required to utilize tht benefit if you choose not to
