I realized it got transferred from I751 forum and brought to this cesspool that Ill never visit again. Notifications kept bringing me to this thread, ill turn them off after this.  

 

It makes perfect sense why the crowd with "ma tax dolla" and "thur steal mar jurb" started popping in the comments. 

 

Im here for legal advice on legal matters, so once I become a citizen in few months, Id never in my life look in the direction of someone who talks in bad light about immigrants. Like I said 300 million people in this country, im here to enjoy life with the humane half, the others who dont share my compassion for humans are free to do so as long as they keep away from my life. Ill vote for what matters to me when I can and you guys do too.

I can assure you that far more than half of are humane and decent humans.  And that 100% of the folks in this forum support legal immigrants and LPRs wholeheartedly.   Need advice on something about USC, AOS, ROC?  Anyone here will point you in the right direction, I promise you.

 

As for the parts in bold, I realize you are probably being dramatic, because no one here says things like that.

Part of this thread is about health insurance. Health insurance offered on the exchanges. Using it will be (according to the memo) grounds for removal and or denial of status. Regardless of if the subsidy was used or not used either and also considered would be if the just the USC spouse or child used it too. This memo isn't about preventing illegal aliens from using the exchange - it's preventing legal aliens, their USC spouses and children from using it. Maybe it doesn't affect you personally, maybe you have private insurance like I do (that are virtually the same plans on the exchange as off of them), but perhaps you know someone that uses it. Perhaps you've helped someone on the forum in the past understand that using the exchange is something they can do to obtain insurance if they want to. All of those persons legally present and currently using the exchange (state or federal) or anyone in the future would be affected. I would think a middle of the road guy would see this as a problematic memo. Nevermind the obvious stuff in the memo it does address that we do actually agree on here. From a libertarian perspective for me, it's the government once again telling a USC and their legally protected spouses what they can and cannot purchase - being penalized for obeying the law, protecting their spouses, and obtaining a legal non-means tested service.

If you support legal immigrants and LPRs, I hope you will understand that what is contained in the memo will affect them in a very severe way if it is adopted as policy. They have obeyed the law and done nothing wrong. This will seek to punish them and their families for it (while not actually changing the law at that).

No ma’am, to be honest, I have been traveling the past 4 days, and the days have been hectic.  No time to delve into that issue at all, I actually got more from what you posted than anything else.  But I hope to read up on it tomorrow.  I only wanted to stick up for the good folks who post here.  A newcomer to CEHST could easily think we are all racist, hateful people who hate everyone.  Wouldn’t want that rumor to gain ground. ;)

Hope you do, the memo is a real mess of a document tbh. Whatever staffer thought it was a great idea should be kicked off the team. You should be used to the lack of logic with memos like that (assuming I read it and agree with you, which I often do).  Look at a LOT of things surrounding immigration in this country.  So many things make little sense.  Like biometrics 4-5 times for a fiance visa.  Or the length of time it takes a Mexican to immigrate here legally.  Or... well, too many things to name that our government has seen fit to put into place.

This ####### from Cheetos Pig is getting ridiculous how in hell for those of us who use H&R Block / TurboTax or accountant that will automatically include this when filing your taxes could be penalized - I have a wife who's I-751 we applied for and I'm nervous as hell right now (I do not have a child and we are trying) but this is ###### up if this get's through - and they said there is a 36 month window they can look into as well? How can someone be penalized for something there was no law for?

Would this affect people who are merely eligible but do not participate in it? SO for instance, if my wife and I are eligible for the EITC... will we be affected if we merely turn down the EITC? Or will mere eligibility for the EITC penalize us?

I believe it you chose EITC while filing taxes it will affect the application. Some are saying this only effects people who entered the U.S. on nonimmigrant visas like student, work, etc. But I believe this pig will make it affect all.

Timeline

A means tested benefit is a benefit you are eligible for because your income qualifies you for it so in that sense the tax credits you may receive through purchasing health insurance through the exchange are technically means tested. You may qualify for them if your household income is up to 400% of the FPL. They can be be taken in advance of filing your federal taxes on a monthly basis to reduce the monthly premiums or if you choose not to take them in advance they will be given as a tax credit on your return. This whole public charge thing baffles me in the first place,  why are the income requirements to sponsor an immigrant set so low (125% fpl) to where the person would qualify for all types of benefits? If you don't want low income immigrants in the country why not change the income requirements for sponsors? In NY 138% FPL qualifies you for Medicaid. So if you are coming into the US making 125% what do you think will happen when you need health insurance?
