Seeing that makes me sad. I hope that you have a backup plan of health insurance to get onto, as being fearful should not cause you to drop coverage based on a memo that we don't know will ever see the light of day. If there was something more to go on than just this memo, then yes perhaps. I would just urge caution for now. You are following the law, and that's what counts.

Hi I just read an article on https://www.vox.com/2018/2/8/16993172/trump-regulation-immigrants-benefits-public-charge in which trump administration is changing what they consider in an immiggrant as a public charggge... It also include taking subsidized health care insurance and people who took it for more then 6 months are not eliggible for adjustment of status...

 

I just want to know if this draft is implemented would it effect my eligggibility to remove conditions on my ggreen card because me and my wife was not eligible for medicaid and my wife is dependent on me... As my income was above poverty level but we had to take subsidized health insurance through blue cross because monthly premium was around 1100 us dollars....please note i am already a ggreen card holder and never took any ggovt benefits for what i was not entitled,... let me know because i am applying for i-751 removal of conditions next month

I've pondered for most of the evening how to best answer this question. I don't really enjoy any of the answers, because they really don't offer much comfort.

But... firstly, you need to carefully consider the wording of the article

Immigrants wouldn’t be punished for anything they have already done as of this moment. They’d only be at risk for any services used after the regulation officially goes into effect — which would take several more months (and include a chance for the public to comment on the proposal).

This is also made clear in the draft memo if you actually get past the mumbo jumbo to read it.

 

However - keep the following in mind:

1) This is only a staff draft. This is not signed off on whatsoever.

2) The ACA is the law of the land, no matter what changes have been made to it. There is no repeal of the exchanges and no other changes made to how it should work, with the exception of next year regarding paying the penalty. Immigrants still remain eligible to use it, unless changes to the law were made. This draft, even if it were made policy, does not change the actual law. That, as the article describes makes something perfectly legal under the law, technically illegal by policy. Especially as there is some language that implies other factors could be considered, such as the USC spouse even using it too. Despite the wording, use of the exchanges is not being a public charge or even means tested benefit (it's a very silly concept to suggest... but that's where we are now).

3) It may never be signed off on - so we have no way to know if it will become policy or not. There's no effective answer here to guide you on it either way.

4) If we get any suggestion that it does or will become policy, start finding other insurance options immediately. Be prepared to make a transition to something else.

 

In short - don't panic for now. Be wary and keep up with following what's going on.

ACA is a LAW, that encompasses all of the US healthcare system, if you have insurance through your job, that means your job if providing you insurance through ACA rules. If you dont have a job you have to get insurance or get fined, which another ACA rule. 

 

Trump did strike down the tax fine if you dont have insurance. 

 

But people, learn what ACA is. Even if you have insurance through private provider its still considered ACA because the private provider has to play by ACA rules.

NB: You do understand that immigrants and their USCs spouses and children use the state and federal exchanges, which are not means tested benefits, regardless of if they qualify for a subsidy or not. This policy would make the use of it as a means to revoke a green card or disqualify for one. There's little difference between a gold tier plan you can buy privately to one offered on the exchange. They cost the same and offer the same benefits, for example. They are certainly not being a public charge.

 

I'm all for making sure people aren't getting access to things they shouldn't. But this is one point that doesn't belong at all. We all signed an affidavit of support, and ensuring our spouses have health insurance is part of that imo... HOWEVER... that's what many USCs did for their spouses, got them legal coverage through the exchange. Perfectly legal to do. And for many that was the only way they could obtain coverage in some scenarios. Not sure what staffers at the DHS thought this was a good suggestion.

Yuna628, do not waste your breath on paper-logistic-materialistic people, throughout all this beauty we call life they have lost all compassion for the follow human being, they are so blinded by so much garbage in their lives, including racism for many, that if a human tried to take their sick kid to a doctor they want them detained and deported. 

 

The US is beautiful with so many beautiful helpful souls, but so many evil people also, blind to its beauty, I def do not respond to these people or let them into my life if I want to keep enjoying the great US experience.

Lol I think you should worry about your tax dollar (1.5 trillion cut) that went to the rich, and the millions on millions for military Parade then some mother taking her child to the doctor on discounted health insurance. But I know I just opened a can of worms, I wont be replying again to worms, thats how I keep my peace. This is a free country, you are within your right to vote for anyone and anything. Take care.

Probably ought to pull up your big boy panties and stop being racist against USC in the country you claim to love and wish to live in.

Every single person in CEHST is either married to a legal immigrant, or a few may still be trying to bring their loved ones over.  Think on that fact.
