The travel permit only prevents you from AUTOMATICALLY losing your residency and thus your Green Card when staying abroad for over 1 year. When you return, with or without travel permit, even after just a few months absense, you'll have to show that you did not establish residency abroad and thus voluntarily abandoned your US residency.

 

I don't see any problems by working for Apple in Ireland, but if you stay out of the US for 366 days or longer, the 2 year + 1 day rule will kick in. That means they count one year minus one day of residency. To avoid that, you should spend your vacation with your wife in your country of residency, which you should do anyway.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . This doesn't apply to just green card holders. If Apple closed its headquarters and moved to another city you would still need to choose if you want to make the change.

So far what I read from the forum and with all the research I've done I will be back before my travel document expires, before November 23, 2018, By doing so I will have only spent 9 months abroad. I'm confident I can get my transfer back to the U.S. by keeping my corporate position and salary. This move is very important to me since I'm transitioning from Apple Retail to Apple Corporate.

Hi everybody.

 

Quick Update...

 

As most of you, I have a 2 year GC that expired Nov 2017 and I filled my ROC on Sep 2017

 

As some of you know I was on a job assignment since March in Ireland. 

 

I was planning to stay here for up to 2 years, therefore I applied for N-470 Application to Preserve Residence for Naturalization Purposes. I recently found out that my petition was denied.

 

I will be returning to the U.S. NY on August 23rd. with 177 being outside the U.S. 

 

1. An absence of More than Six Months (but Less than One Year)
An absence of more than six months [more than 181 days but less than one year (less than 365 days)] during the period for which continuous residence is required is presumed to break the continuity of such residence.

 

So I don't think I broke my Continuous Residence and Physical Presence

 

During my stay in Ireland, I kept strong ties to the U.S. such as;

  • Learner Permit
  • State ID
  • Petition for Travel Document (Re-Entry Permit) ( I-131) valid till Nov 2018
  • Active Phone Bill
  • Internet
  • 2-Year Apartment Lease
  • My Spouse stayed in the U.S.
  • 401k

  • Dental Insurance
  • Checking Account
  • Savings Account
  • Credit Cards
  • Personal Loan
  • Tax Returns 2015, 2016, 2017

 

I was wondering how can I be prepared for questioning by the officer at the airport? 

 

Any suggestions would help a lot.
