In some countries unlawful presence could be considered a criminal offense or at the very least lead to an arrest, criminal trial and deportation. If that happens you'll have to mention it on every US immigration form.

Your illegal status in another country will have no impact in your K1 at all nor will it make it difficult to obtain a police certificate. Those saying otherwise are totally wrong.

However, one piece of advice before you leave that country. Get your police certificate from that country while you are there. It might be harder to get and more expensive if you have to do it outside the country if you are not a legal permanent resident of that country while you were living there. Depending on the country, police certificates can even be obtained online and they will be mailed to your address in that country but only if you are currently living there. So I’d do some research on that before leaving if I were you.

How can you know that when you don't know which country this person lives in illegally? When I applied for my police certificates I had to fill out ALL addresses I had lived at in those countries. And what will happen when they realize that the person in question got no connection to those addresses?

Hi Londonergirl. I don’t know as to which extent will they check all the addresses but I only stayed to one address since I came here and have my name on both electric and virgin media bill. Thanks

I have no idea either as I don't know what country you live in. But where I lived before moving to the US I had to apply for some special police report where they required a lot of information. I wish you all the best.

That’s why I said depending on the country. I speak from experience because it was a major hassle and extremely expensive for me to get a police certificate from Canada after I attended school there and was no longer living there.
