Hello, I am a US citizen and wish to adjust my Chinese mom's status from a B2 Visitor Visa (10-year) to Permanent Resident.  She currently lives in Guangzhou, China, and will be visiting the U.S. for several months in May.  I am filling out the I-130, and am confused on how to respond to questions 61 and 62:

 

61: The beneficiary is in the United States and will apply for adjustment of status to that of a lawful permanent resident at the U.S Citizenship and Immigration Services (USCIS) office

62: The beneficiary will not apply for adjustment of status in the United States, but he or she will apply for an Immigrant visa abroad at the U.S. Embassy or U.S. Consulate in

 

Any help will be appreciated!

If your mom is not in the USA right now then you are not adjusting her status. B2 has nothing to do with it. 

 

You're applying for the parent visa. Question 1 - no. Question 2 - yes. 

 

Planning to adjust status from the tourist visa is a fraud. Don't do that.

Sorry I think I got confused about the terminology on these forms--I didn't realize Adjustment of Status had an implication of a different process.  I understand now that I am applying for an immigrant visa for immediate relative (parent).  Thanks, saved me some headache of unintentional fraud.

 

As far as processing times go--will my mother receive communication from the US Consulate in China, or will I receive communication from USCIS, or both?  Any idea on when we could expect to hear from them?  My mom is planning on visiting the US from mid-May to end of August.  Thank you!!
