I am the petitioner and my husband is the applicant. We have the Waiver approved for my husband entering illegally to the US and the I130 approved as well. My husband and I went to the US embassy in Honduras on January 19,2018 for the interview and the agent said the visa for my husband was approved and said we had to wait 5-10 business days. After waiting the ten days they said, I checked on the CEAC website and it says “Refused”. They never gave me a document or anything at the interview stating it was refused or anything. We had all the documents correct and given to them before entering the room to be interviewed. I have called the U.S. Embassy in Honduras and said to wait and to send an email to the U.S. Embassy but still no answer. They cannot tell me how long I have to wait or document they need if there is anything missing. I have also called department of immigration and National Visa Center and they said that it is not in there hands anymore, it is in the hands of the US embassy. I have been here with my husband and my two children for over a month and 1/2 and still no answer. Help!!! I need answers! Should I go to the US embassy myself and ask what’s going on?!

The CEAC status is basically meaningless. No human person updates that status. 

This was the last time it was updated. 

Thank you for the advice. That’s what the agent on the phone told me to just wait, but you it’s frustrating after waiting for so long to get to where we are in the process and then have to wait again.

Update: Received a denied from them on February 5 stating “

 

We regret to inform you that your application has been denied under the following section of the law: Section 212(a)(6)(C)(i) of the Immigration and Nationality Act which prohibits the issuance of a visa to “any alien who , by fraud or willfully misrepresenting a material fact, seeks to procure(or has sought to procure or has procured) admission into the United States”. You can apply for a waiver of this ineligibility if you are the spouse, son or daughter of a US Citizen or a Legal Permanent Resident.”  Do I have to apply again the waiver if I already have one approved from them the waiver601A?

Seems like your denial is based in something that happened after your last waiver was approved?. Do you know why they said you committed misrepresentation?

 

I think the 601a only covers unlawful presence, and you need a waiver for the misrepresentation.

No I do not know that’s all they sent. I was thinking of going to the embassy tomorrow to ask specifically why they denied it but I do not know if they will want to help me or should I call? I’ll be leaving to US on Sunday to find an immigration lawyer.

It's something very serious, so I won't suggest to not go there, but is unlikely they would give you any information on phone or if you ask at the embassy. You should receive a letter in the next couple of days stating what happened.

I would suggest to involve your congressman in case they are able to get a clear answer.

 

If the denial based on misrepresentation happened, you will need an inmigration lawyer, better if is an expert in waivers.

The strange part is that you said everything was ok during the interview and the CO said it was approved. So the time under AP it's fine and very common, but a sudden denial with such extreme accusations without knowing what happened is very weird.

I recently contacted my congressman office and they sent me the letter that I posted here. I didn’t see until this morning because somehow it went to my spam folder and it was sent on February 6. It is very strange that they said it was approved then it was denied.

I think you must receive a notice with that decision, not sure, but I've seen the details of a denial in the hard copy. So be aware of your mailbox.

Interesting I am starting off the same my husband currently in Mexico had his apt 7-31-18 gave him an approval notice it has not been the 10 bd yet but on 8-3 it said issued and now on 8-7 it says refused I am going to wait the full 10 bd to check again but we already have an approved I-601a on file as well . I hope the status changes as I don't know what I am going to do without my husband we have already been married for 9 years . We are just now getting his papers.  Please pray for me !!!!
