If you are ready for a long wait(As I know 7+years) then you can start.
Good luck

This applies for siblings, in this case if she adopts them a completely different set of criteria apply

To the OP, I hope someone will chime in on this

from what I can tell you are eligible to adopt them and then you can petition them, you would need to follow the adoption timeline

It is difficult to adopt a relative in a way they will get an immigrant visa.     https://travel.state.gov/content/travel/en/Intercountry-Adoption/Intercountry-Adoption-Country-Information/Kazakhstan.html     You may get tripped up by the required 16 year age difference unless there is some sort of exception.

This will not be over quickly. You will not enjoy this.

I agree, there are two separate issues, can you adopt?, seek guidance from a local lawyer.

Second is I assume you want them to immigrate to the US? Which is another totally separate issue, is your husband looking to migrate to you in the medium term?

Did you apply for a re entry permit, or will you be abandoning your GC status?

my husband is 31 years old. so 16 years difference reqirment is not the issue. if i would be adopting alone it would be an issue..

Don't you have to have lived with the child for more than two years under Hague definition?

Just when you think you have TDS eradicate,  a new case shows up.

In our case they are my brothers. If they would be from the foster house then yeah...

gotcha.  I see this same question asked in the Philippines forum. Someone comes to USA and then wants to adopt usually a niece/nephew,  and try to immigrate, I see the 2 year rule as the deal breaker.

I agree it looks like the OP does qualify to bring them to the USA because of their parents passing away. But having to actually do it is a different story and I am sure that it is not easy at all.

OP, Best of luck to you ma'm. I really hope you can bring them ASAP.
