Hi...

I have way more income than I need to qualify for sponsoring my fiancé.  It is not a problem.  I will have the 2017 tax return, the 2016 tax transcript, 4 or 5 years of W-2's and the employer letter.  Is this enough?  I am really embarrassed that my 2016 tax transcript was married filing jointly with someone else.  As a matter of fact, it really does not reveal anything to them about MY financial situation because it is given as total household income rather than two separate individuals.  I really do not want to go and order a second one of these.  It looks bad enough to be submitting one with another man's name on it.  Don't they want info that is representative of MY ability to sponsor?  Additionally, I don't feel it is their right to have any information about how much money my ex husband makes.  They can scrutinize me and my fiancé all they want, but I do not want to be giving out confidential information of another US Citizen.  They could find it themselves if they really wanted to.  Will I be ok with the 2016 transcript and the 2017 return?  I could even get end of the year pay-stubs for the last 12 years if they wanted.  This information is about me and not my ex-husband.

important income is current with the last years tax returns /income to meet 100% poverty level (K1) for Number of people incluidng financee that will be living in the house 125% for AOS after marrying

more important you may need to explain if you were communicating while married 

and  sometimes if there are religious differcnes,  age differences,  did you meet,  how many visits,  how long were visits (need quality facial time for African embassies)

does his family approve/ especially his mother

good luck as this is hard embassy and you need solid proof plus he needs to know every little and big thing about you

he needs to have future plans in the Us (will he work after getting green card or study)

Your embarrassment and how you feel doesn’t matter in this process, sorry to be blunt but there it is. They just don’t care, it’s a bureaucratic process.

 

They do not go looking for documents they require to process an application that is up to the petitioner and beneficiary to do.

 

If it really is that embarrassing/undesirable you could amend the tax returns to married filing separately and give the irs back any refund difference? Though I think you still have to list the ex on that even if his financial information isnt being included. 

 

You say you don’t want to order a second one of those, are you referring to the 2015 transcript or were you still married to the ex at the end of 2017?

 

This raises an interesting question, when getting co sponsors who file as married filing jointly those spouses also fill out a form but in this case you would not be required to have the ex file a form as you aren’t together. Seems like a double standard.

I was not married to anyone in 2017.  I was saying that it seems foolish to give them my married filing jointly tax transcript.  I will order it and I will attach my W-2 to it so that they can see how much of that income was mine.  The same thing with 2016.  I suppose that solves the whole issue.  I was just wondering how useful it was to give them a 2016 tax transcript that said that the household income was 125,000 in 2016, when only 52,000 of that was mine.  Since it is not differentiated, that seemed dumb and not to give them accurate information at all.  But, if I attach my W-2, that should clarify it for them.

None of that is a problem!

If anyone else ends up reading this, I found out the answers I was looking for.  I'll copy them here so people can read what I found.  It came from RapidVisa.  Incidentally, I just ordered the last 4 years of tax transcripts.  I have my own 2017 tax return.  I have 5 years worth of W-2s.  I will print up my latest 3 pay-stubs, I will get the employment letter.  I suppose it is better to have too much evidence than to have too little.  The fact of the matter is, I just want them to be considering my income, not someone else's because no one is going to be helping me. 

Initial evidence of sufficient income includes:

    • Copies of three (3) most recent years of tax returns that the sponsor filed with Internal Revenue Service. If the sponsor does not have copies of these records, he or she will need to provide an explanation as to why the tax returns were not filed. If the sponsor filed a joint tax return and are using only their own income to qualify to sponsor, then it will be required to submit copies of W-2s for the most recent three (3) tax years.
    • If the sponsor has other income sources such as members of household or dependents in order to reach the minimum income requirement it will be required to include their federal income tax returns for the three (3) most recent years. In using other income sources it will be required each person complete Form I-864a, which is a contract between the sponsor and household member.
    • Proof of current employment or self-employment will need to be provided. Copies of recent pay stubs or employment verification statement from the employer on company letterhead that states the start date of employment, work performed and current salary.
    • Statement from an officer of the bank or other financial institutions with deposits, identifying the following details regarding the account:
      • Date account opened
      • Total amount deposited for the past year; and
      • Present balance
    • Statement(s) of your employer on business stationery showing:
      • Date and nature of employment
      • Salary paid; and
      • Whether the position is temporary or permanent
    • If self-employed:
      • Copy of last income tax return filed; or
      • Report of commercial rating concern.
    • List containing serial numbers and denominations of bonds and name of record owner(s)

It is important to complete and include all the necessary supporting documents when submitting your affidavit of support. Failure to completely fill out Form I-134 or not include the appropriate documents as supporting evidence could result in denial of the application.
