Multiple Filer Waiver Request Info

Hi, for some reasons my fiancé and I forgot to check one of those boxes under the Multiple Filer Waiver Request Info before he sent the application. We've just realized it now when we checked the i-129f form again. He has never filed a petition before and this is his first time.

Any of you know what the USCIS would do in cases like this? Are we gonna get denied just because of it? What should we do?

Thank you!

I think the worse case scenario would be an RFE.  I don't believe they would reject because of a checkmark on the form.  If they catch it I would expect an RFE.

OK. Do you think we can send them a letter and explain it to them? Would that work?

I am not sure about that.  I hope someone else can answer this.  It may be easier to wait for the RFE.  I am wondering if that change can be made without screwing up the timing.  RFEs generally don't add a lot of time to the timeline.  This is an easy one to answer.  If it were me, I would just let it ride and see what happens.

We recently left something out of our file and sent a second package to them explaining in hopes they could match the files but even though it was only a day apart since our first file sent they mailed it back to my fiancé. So I would be inclined to say just wait for the RFE. Of course I’m not an expert at all but just based on what I’ve read here, too, it would seem that’s the course of action.

Were you approved? Did they send you an RFE

We are nowhere near that stage yet. We are just waiting for the RFE which is several months away.

Thanks. We’re just afraid that we’re gonna get denied just because of it.

Understandable! And I can’t say if you will or not. Hopefully it will just be a RFE.

The adjudicators at the USCIS are not heartless.  They give you every opportunity to get a petition into approvable state before it is denied

YMMV

I hope so. We are freaking out right now. Do you think we should mail them a letter with a detailed explanation before they send us an RFE? Do you think it would help?

If it was me, I would wait.  Many reports of people who try to submit evidence in advance of getting an rfe that never gets married up to the file

I understand that. But it would do no harm if we do that, right?

Would do no harm, but would be of no help either if it's not matched up to your file as noted above.

Honestly, it's better to wait and see if you are sent an RFE.

You won’t get denied for not checking a box. Maybe a RFE or they may simply overlook it, they can see if he has filed any prior petitions or not. Just wait and see. If you get an RFE, check the box and send it back in the same day and you should have a quick response. Nothing to worry about
