If the documents presented were the same ones that resulted in the 1st and 2nd denial, then unfortunately the chances are slim.

 

Perhaps you and your mom can travel to her.

While I can respect what you are saying, and understand why you are perhaps thinking along those lines---you have to realize that USCIS is not denying *you* your right as a USC...you are free to live in or leave the country at any time, with guarantee of re-entry, as is your right as a US citizen. 

 

Unfortunately, being a USC (and even serving in the military) does not extend your same rights to someone else---or a foreigner---just because they are related to you (ie. your spouse).  Along with everyone else applying for B2s, she must meet the same criteria and there is no provision made based on the familial history of someone else.  

 

As an option, is there any chance you and your mother can take a trip to your wife's home country so they can finally meet?

I have told my son about the good of the USA his entire life. because I hate the USA but because he can never see that. i can not take him fishing in Pensacola where my father took me fishing. The things a father does with his son are being lost. Why not a vacation to do these things?   I have loved this family with all my heart. I have provided for them encouraged truth and honesty. It doesnt count for anything it seems. It hurts very much. Its a fear of the future and anxiety we get. This is my final post and I wish every member the best of luck.

You should apply for a greencard for your wife!!! Then she can have the greencard and come and visit and then when she hands the greencard back, she wont have a problem after that in getting a visitor visa!

 

i have seen that as the only option at this point! basically, it is alot of work as you have to prove you will move to the USA ect. and it will also cost you 2k.  but that is the easiest and best option you have at this point:/

Depending on the age of your son, he may qualify to apply for citizenship through you and sidestep the issue (for him). If he has already been denied, I think you could petition him on an immigrant visa and once in the US he could become a citizen. I am a little hazy on the details - does anyone else know? A grandparent may also be able to do it.

 

Alternatively, you might have to make new memories. I'm sure that there ihas got to be some pretty good fishing where you are now.

That's a great idea! It depends on the circumstances as to how to claim his citizenship. We had to do IR2 but it was considerably easier than petitioning for a spouse. Others are able to do CRBA (consular birth abroad). At least for his son it's an option worth looking at.

Then have your family visit you. 

Being desperate doesn't help and after being denied twice her chances for a visa are pretty much 0.

 

Since you're the USC you're the main reason  why she is not getting a tourist visa. Immigrant intent. ;)

Horrible idea. I think the embassy people aren't stupid and will see that she only used her green card as a "tourist visa" and mighy easily deny her future visas. Why would you recommend someone to ruin their immigration history? Not to mention husband would have to go through the domicile thing.

Since tourist visa keep on rejected. Why don't apply for spouse visa instead of keep trying with tourist visa?

The reason I stated my ties and history in the USA is because it is who I am. These are my roots that I wish my wife and youngest boy to know. These roots do go back to the Mayflower that mcdull stated. My Fathers have fought wars and served the United States with honer  This is highly personal to me. I know that is a mistake but i find it hard not to take it that way. 

Your mother can meet her by flying where your wife resides or to any other country. It has been done a thousand times. The US is not the only place in the world where they can meet.

You may think whatever you want, but the CO had an intent to protect the law rather than take it the way you feel about all this. It's their job.

I am afraid unless her situation changes, she will be denied again. The embassy will gladly take your $160, but think about this: if you try again and again, your wife will have 5-8 denials within 1 year. How will it look to CO when she wants to apply for the 9th time? I don't think she will look as a tourist (applying for a tourist visa), so she will get a mark "in very need to be in the US no matter what" in the system.

From the original post, the wife has "no desire to leave remaining children/grandbabies" in her home country...so sounds like she's not intending on living in the US permanently, as to my guess why no spouse visa has been attempted.

Is important for you to know that:

 

1- Regardless of she being married to an USC, that doesn’t mean she will get any immigration advantage to get a tourist visa

2- Immigration is a benefit NOT a right for USC. You are allow to request your spouse, children and parents but in many cases, even these type of petitions get denied, especially spouse visas. Because is NOT a right. If the USCIS determines the person you are married with is not fit to immigrate, it will be denied. 

3-She comes from a 3rd world country and our countries (I come from one myself) have the highest denial rates. 

4- Regardless of being married to you, she is being subject to the same rules as ANY other tourist, being married to you doesn’t give her any special treatment/advantage/benefits among other tourists. And to be quite honest, she doesn’t seem to have strong ties with her homecountry. I totally believe you that she just want to visit, but according to the evidence you share, it looks like she has no strong ties. Plus many of the evidence might hurted your case more than help.

 

With all respect, and as a general comment, is quite interesting as many US citizens have the  misconception that immigration benefits are rights. I’ve seen this quite too many times. These are not rights, are privileges and or benefits.

That means she will need to live in the States as the result of the a spouse visa (when approved) is a green card. And a green card is meant for people who actually wants to reside in the States. She cannot get it and then live in her country most of the year as she will lose it.

Why is that horrible? He is a usc...this is perfectly legal and people have done it before to visit especially for a long period of time.and then handed it over.

 

Imo this is her only shot of visiting America so if u have the funds I say go for it!
