Discrimination? - HR lady asked to show green card during hiring process

Hello all,

 

I got a new job and today I went to fill out the hiring paperwork.

 

When I got to the I-9, I stated that I would like to present my State ID (one of the documents from List B / identity) and my unrestricted Social Security Card (one of the documents from List C / employment authorization). 

 

However, when I got to the part that I'm a "Lawful Permanent Resident" and had to write in my A#, the HR woman said that she has to see and take a copy of my green card.

 

Is this even legal?? :blink:

 

I was shocked Because my State ID and unrestricted Social Security Card ALREADY DO verify both identity and employment authorization, so there is absolutely NO reason for her to see my green card or whatever.

 

I told her that my green card is expired and that I have an extension letter and she took a copy of both my expired green card and extension letter.

 

I-9 instructions clearly say that employers must not demand that an employee show specific documents:

Don't understand why this bothers you so much.  If HR wants to see it, so what?  You could have refused show your Green Card if you wanted.

When I was hired at this job few years ago they only requested the A#. I happened to have my GC with me at that moment so I showed to them and made a copy.

Nope, can’t demand to see GC if you decide to provide other acceptable proof (usually driver’s license and unrestricted ss card).

Thank you. If I'm correct, this falls under the category of "document abuse".

Employers must not

  • request more or different documents than are required to verify employment authorization and identity
  • reject documents that reasonably appear to be genuine and relate to the employee
  • specify certain documents over others based on an employee’s citizenship or immigration status, or national origin

I work for a law firm and I wear all the hats.  When we hire new people I have them fill out the papers and I had one guy whos card was about to expire and I assisted him on getting his card renewed.  With 45 in the white house, its making everyone uncomfortable.  I noticed that a lot of people are asking for documents so that they cover their butts should anything arise.  Some call it discrimination and others call it abuse, I personally dont see it that way at all.  I see it as protection.  Please dont get me wrong but if you come here to live in the US you are subjected to the same as us BUT I do understand that you feel its not necessary to be subjected to this.  Just know that I do understand your situation but please understand theirs too.  I hope and pray that you got the job and that you have a great experience here.  Wishing you the best.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
