Hi All,

 

I haven't been here in a long time. Got my 18 months extension letter on 8/20/2018. And I received an RFE yesterday 2/3/19.

Good Faith Marriage, insufficient evidence. You provided the following evidence that the marriage as entered in good faith:

-auto-insurance

- Bank Statement

- health insurance

- letters

-photographs

-travel documents

-tax documents

 

However, the documentation submitted is insufficient because you submitted limited evidence. Aside from a shared address between you and your spouse displayed on multiple financial documents, you submitted no other evidence of joint occupancy with your spouse at the same residence. Such evidence  might include: mortgage payments, a shared deed to a property, a lease/rental agreement, or property taxes. In its' entirety, the evidence submitted is insufficient to prove joint occupancy with your spouse at the same residence. 

 

To establish eligibility for removal of conditions of residence, please submit additional evidence to show you and your spouse entered the marriage in good faith and continue to share a life together. The evidence may include the following :

So looking at the above of what they want is really a documents showing my name on the property/lease. Little background, my husband has purchased his house before we met. So then we decided to move in together in the same house. But my name is not on the house, we did not think it was necessary since we were planning to move in the future. 

But my husband is adding me to the property,  would that be sufficient? do you think we should add more evidence?

Yikes!.... the USCIS officer handling your case must be having a bad day a work.

 

Do all of the documents you sent with your ROC petition have BOTH you and your spouse name on it? Same address?

 

If most of the documents only have your name and address USCIS will consider it inefficient.

 

For example our case was approve with the following documents with BOTH our names and address on it.

 

- Bank Statement

- Credit Card Statement

- Auto Insurance

- Vehicle Title and Registration Documents

- State issue DL (Me and my Spouse)

- 4x Photos (Us with family and friends)

 

We forgot to send our Rent, Utility, and Tax Documents but they didn't ask for it :)

I would think a deed to your house, now that your husband will add your name to it, a copy of both DLs (your and your husband’s), and maybe a doctor’s note that you are expecting a  baby with history of maternity consultation along the way should do the trick.

 

It sounds to me that your adjudicator would like to see things that carry more weight — real properties (house deed, car registration) and child(ren) usually carry more weight, most certainly.

I think you are lucky...I am really surprised that they approved you without rent/mortgage and tax documents being sent in to them.

Thanks for sharing and sorry to hear about the RFE. Sounds like you got a good amount of detail on how to resolve the RFE, though. It may help others advise if you list what you initially sent to USCIS? There will be comparisons with others, but each case seems to be unique and as much as we hope everything is adjudicated fairly and systematically, I do wonder whether that is really true.

Actually, I think state-issued DLs with the same address is pretty strong evidence of cohabitation. Especially if your state DL meets the REAL ID standard. DLs 1) are official documents, 2) require other documentary evidence of residence to obtain, and 3) are difficult to falsify -- at least more than other types of evidence.
