My thoughts on joint filing and they are just that, my thoughts!

I have been informed in the past that they work with actual boxes (the big cardboard ones) and depending who opened the envelopes the files are stored in somewhat random order. That's why we don't see consistent approvals based on numbers. When ever a box is empty, an officer will grab a new box and starts processing files. Again they could start from either end of the box, leading to more random approvals. Taking into consideration that people work at different speeds, sometimes get sick, may work half days and boxes get moved a lot you can see why we appear to have random approvals but still are able to get within a few weeks.

 

Knowing that here are your options when filing the N-400 to speed up the Removal part.

If you do it now, while your file is on it's way to the top of the pile, you will get delayed. They have to pull the file, sent it to your local office and there we go again.

If you filed while your file was still in storage, you had a decent change of speeding things up. File got pulled sent over to the local office and you by-passed the line.

If your file is currently in limbo, (it should have been approved based on the numbers around you, but you still haven't heard anything) you need to think it through. It might be that it fell off a desk or got stuck in a box and your N-400 starts a search for it. Than it will benefit you. But it is also very possible that somehow your file ended in a box with non matching numbers. Now if the officer grabs that box next you screwed yourself.

 

Generally I would lean towards the "ship has sailed" side and February filers are to late to benefit from N-400 filing with the pending removal petition.

Checked Case Tracker today and it says RFE is on its way. Kind of expected it, given that the status has not changed for 67 days. I will be sending the tax returns, car title copy with our names, car insurances, joint bank account. However, i had couple of questions to our community here:

1. My wife is not on the lease for our apartment, she had to get a NJ drivers license when she was working in NJ. What should i do with the lease agreements? I have a feeling that they will ask for them as well. 

2. This question was already asked here i think, but i dont remember if it was answered. Tax returns records can be downloaded from IRS’s website however they have the names and SSNs redacted. Would that be good enough for USCIS? 

Thank you in advance for your answers. Hopefully all this stress will be gone soon.

Now that i am completely awake, i read the status change and it says REQUEST FOR INITIAL EVIDENCE. “On April 22, 2019, we mailed a request for initial evidence for your Form I-751, Petition to Remove Conditions on Residence, Receipt Number EAC180” 

Is it any different from RFE? Or these are the same things? I remember reading somewhere that REQUEST FOR INITIAL EVIDENCE meant that we may have missed something when we filed my i-751. Is that right or its just an RFE? Please share your insights.

Sorry to hear about the RFE. On the positive side, once you give them what they want, approval is usually just around the corner and you shouldn't expect much delay. 

 

1) If you can get her on the lease agreement then that is your best bet (depending on your landlord I'm not sure how long that will take, though)

2) Fully redacted? I don't recall them being fully redacted, but yes, if they are unidentifiable then probably no help, but those that I obtained weren't redacted.

It's the same thing, request for evidence.

@starsky thank you for your reply! They are not fully redacted, as far as i remember the names and SSNs are partially redacted. However, i do remember on IRS’ website where you can download them, they give you an option who and what you are downloading them for. It had an option immigration (with redacted info as well) so i am guessing that should be good enough. 

About the lease, i dont know if i will be able to make that change now and how long that would take. I will ask the office tomorrow and see what they can do about it. Besides, my wife is abroad now and wont be back till mid may.

This RFE has given me mixed feelings. On one hand i am happy that my case is moving, on the other hand it “plays” with my nerves. Will see what happens.

Hello guys  i have a question for you , i hope you can help me please. I had to file married filling separately this tax season because we would owed too much if we had filed jointly. This is the first time i have ever filed separately, we did file married for the last prior 4 years. I am a little concerned because my ROC is still pending since March 2018 . My question is : is that going to affect me if i get an RFE? If yes, what should i do ? Any advice will be greatly appreciated.🙏

We did the same thing this year. I dont know if that triggered the RFE, but we had to file separately because i was self employed last year (1099) and we would have owed too much if we’d filed jointly. I cannot be sure if that was the factor for USCIS to issue an RFE

We have filed jointly till this year. Waiting for my RFE letter to come and we’ll see what else they requested for. We have filed tax returns, our lease agreement for our old apartment, bank statement, several photos (not a lot).

i am planning to send our insurance cards for our cars, a copy of the title for one of our cars, i have started a new job and have 401K setup recently with the company and have my wife as a beneficiary on the account so that will be sent as well. Moreover, we will probably include phone bills (both our names), utility bills (1 on my name 1 on hers). However, we dont have new photos made though, so probably wont send any. 

Cant think of anything else that can be sent. We will keep thinking 😏

Also she is an authorized user on one of my credit cards, probably will send that too. Anyways, i hope it will all be good enough to get our approval and finally be done with i-751 process. 🤞🏻

@Al135 Thank you for replying, I haven’t received any updates yet my case still says “case received “ no updates since last year. Please let me know how it goes for you. Did you file separately last year when you sent your application or this year while it was pending? I did this year but we sent 3 jointly on the application. Do you think ill get RFE’d? . My case is in California (WAC181225)

We filed separately this year while it was pending. But I really don’t think that it triggers RFE. To be honest, i would even be able to guess if you are going to get an RFE request or not. it seems like all this depends on who reviews your case and what evidence they are working to start with. Good lick and hope you will get approve without an RFS.

Same here, with a pending i751 since late February 2018, and our tax preparer advice we file married file separate, otherwise will will own a lot, but I told my husband no, so we did file jointly and we own money, which we are prepared to pay anyway. 

 

I dont want any small distractions with my pending i751 and planning on filing n400 after approval of i751. 🛑

 

consider many things, and think 🤔 about it.

Got the RFE in the mail today, got to read it quickly but I need to go through it again. Anyway looked like I did not include a lot to begin with (as stated before I was expecting an interview so wasn't to bothered in supplying endless info) but also they have lost a bunch of stuff. It states the have tax returns for 2015 (I included 16 but not 17 as it was not done at the time). they are talking about 1 phone bill. I included about 4 of them. 1 medical insurance record (there were more of those as well). joint car title and that is about it. So it looks like I'll be spending a few days trying to get some more stuff. Fun fact. All digital photo's were wiped about 3 weeks ago (Hard disk crash)so there are about 4 of them. I'm not on the house and we both are against joint accounts. So it will be interesting to say the least.

Thank you for the info, @Fr8dog! It “amazes” me how they manage to loose sent documents sometimes. It might be difficult to provide copies of some stuff (i.e photos) if they are lost. Like in your case.

We also don’t have a lot of photos to share and we have sent all the good ones already. I cant imagine what will happen if they loose them and request for another copy 😖

however, it looks like you have enough stuff to send over and hopefully it will all go smoothly for you. I am waiting for the actual RFE mail to arrive.
